The decision affirmed, without circumlocution, is that an order of tue Board Of Supervisors making a reduction of 15 percent in an annual collection from city and citizens of 1,434 249 64 for water is 'grossly unreasonable, uujnst, and oppressive, and amounts to the taking of tli property of plaintiff for public use without just compensation, and without due process of law." The order in question is clared to be of the chamc.er stated be- -cause it does not provide for the payment of tbe interest on $9,000,000 ot indebtedness 7 per cent (a raise of 1 per cent) on its $10,000,000 of stock; for running expenses and lor taxes. The supervisors, as a consequence, are ordered to pass another order aud "so fix the said rates that just compen- sation shall thereby be awarded a-nd given for the water supplied to the person, company or corporation furnishing the same." An. order incompliance with this judgment, apparently must provide for the raising of the following sums: $498,000 for interest on bonds, $700,000 for stockholders, $390,000 for running expenses nd $70,000 for taxes. Guernsey of New Yor having asset ted that there are no more hard shell homeopaths, no Hiore true believers, Dr. Gatchell of Chicago indignantly exclaims- that the heretic should at once retire from the management of the homeopathic hospital and leave it in charge of one "in whose keeping the interests of homeopathy are safe." The hospital apparently was established in the interests of homeopathy and not of the sick. The latter are merely (in Dr. GatchelPs view) incidental to the grand object of promoting homeopathy, and if they cannot get well under that treatment so much the worse for them. Prjbablv Dr.

Gatchell has not many supporters in the profession, and it would seem that his object would be quite as well attained by using the pilules on a wooilen Indian or a dog. Norris, the well-known rancher of San Ramon, we gleaned somewhat of an idea of the extra expense caused by tbe long spell of wet weather. He good natnredly remarked: "Well, since the wet season began, close on to two months ago, I have been feeling three hundred horses and forty men.

Of course it is not necessary to-feed bat ley to the horses, but just the same they ea'i three and one-half tons of bay every day. And the men, well they eat just as regular as if they were working. But the bitter mixes with the sweet, and we farmers have to take the bitter along tbe sweet jast the same as the rest of ordinary mortals." A GOLD DISCOVERY. Pay Quartz Dincovered at the Agua de Virtu Springs. Livermore Herald.

Some years ago William M. Mendcn-hall discovered what he considered to he copper pre on tbe hillside near the large spring at Agua de Vida, ten miles southeast of this place. The Whe cott'f nhed in digering a trail in the cottage to the spring. Liast summer 'Mr. Mpndenball decided to run a tunnel into the hill on the ledpe.

He did so, getting in about thirty feet. The ore be took out was seen by quite a number of people, nearlv all of whom pronounced it copper. Recently he sent three samples down to Price's assay office, and this week he secured a return which, to say the least, astonished him. Of the three samples of rocV, that from a small vein assayed 84 cents in silver and $3 10 in gold, per ton; that from a ledge. 13 cents in silver, and $2 07 in golH and the quartz, 45 cents, in silver and $9 30 in gold.

This gives a return of valuation of the three specimens of $3 94, $2 20 and $9 88, respectively, per ton. Id a Bad Place. Haywardt Journal. E. D.

Brown of Redwood canyon reports a slide nearly half a mile long on the private road built by the water company back of bis place that is used to reach 8an Leandro. Mr. Brown related a narrow estipe had bv his family in crossing San Leandro creek, that has to be forded to reach the Redwood road. His son Edward was driving, and in the back seat his wife and daughter. The creek was booming and tbe water came up even with the box of the waeon.

The torrent had washed out part of the road, and when the team reached the bank, the "eyener', snapped and left tbe hind end of the wsgon the WBter and the front wheels on the bank at an angle of 45 degrees. To say tbat the occupants were scared is putting it mildly, and tbev climbed out of the wagon in short order. The wagon was soon landed all runt, the horses caught ana no aamage whatever doae to speak of. A Factory for Livermore. Livermore Herald The proposal of Tnoma Driver to erect and maintain a harvester maim factory in this town, which we stated last week would be received soon, came to band this week.

He asks a site and $3000incash. He will put up a building 60x200, with engine house and foundry, at tbe beginning, and build twenty harvesters, worth $32,000, this season. Next season he will turn out double lhat number, besides as many seed cleaners. He has a substantial backing, and there is no difficulty in selling the machines. This morning some Jseven or eight of our leading men started out to canvass the town on the proposition.

They are meeting with good success. An answer must he made at ence, as several other towns and a San Francisco firm have made good offers. We are given the preference of a refusal on account of our advantages of climate and location. An Old Soldier. Haywardt Journal.

Jose Peraro Fortado. aged 9f3 years, a resident of San Lorenzo, departed this life on Tuesday, the 21th and was tkiiiio1 in Ilia Pathnlin nmptArv in thia place Thursday. Mr. Fortado leaves a widow aged 92 years. This couple have lived happily together for over forty years, two daughters and a son being born to them.

Onedughter is the wife of A. Lee of Alvarado. The deceased served for over twenty years in tbe armv in hi9 naiive couniry, and had resided in this valley for almost fourteen or sixteen years. Transfer of Keal Entate. Haywardt Journal.

There must have been tons of rich sediment carried down the Sau Lorenzo creek thi9 winter, for it has settled on the lauds near Robert's Landing to the depth of fully two and three feet in many places. rV. 3. Cull, the well-known rancher of Cull canyon, was in town this week and reports considerable real estate carried off along the bank of the-Cull canyon creek. A number of big trees fell into the creek, and considerab.e fencing was washed away.

Kipe Raspberries fur Christmas. Haywardt Journal. This neighborhood is noted for its early berries, particularly the raspberry. Some time ago we mentioned the fact that D. Culp bad ripe, raspberries.

Now comes T. Missen, residing near Lone Tree Ceuietery. who presented us with a box of ripe raspberries Tuesday. He reports having ripe berries for over a month past. The vines erow in a gulch and bear a remarkably neavy crop.

Killing Bobins. Livermore Herald. There has been a remarkable migration of robins to this vicinity recently and they are being slaugthered for pot pies in large numbers. D. T.

Coffman, foreman of the Olivina vineyard, killed 98 on Tuesday of this week. Ue shipped qaite a large number to the city. A Ledge of Coal. Livermore Herald. A land slide on George Johnson's sheep range, south of the Patterson Pass road, ten miles east of Livemore, has uncovered a ledge of coal.

The admission that the rates in the San Francisco ordinance were unreasonable was merely made for the purposes of that particular suit, because counsel deemed it best to stand on the single issue of law. Neither does the court assume the unlimited jurisdiction of" a court cf appeal on such -matters from municipal governing bodies.
