criminal conspiracy to obtain secret ownership of the Frontier Hotel and Casino in Las Vegas Emprise was convicted only on the conspiracy charge which carries a maximum fine of $10000 Anthony Zerilli of Detroit was convicted on seven other counts Michael Polizzi of Detroit on five and Peter Bellanca the secretary of Hazel Park in Detroit on six Each count carries a maximum penalty of five years in prison and a $10000 fine In its April 29 issue Sports Illustrated devoted 10 pages to Emprise The article covered the history its legal problems and named a large number of men of unsavory reputations with which the firm has done business The article contained little if anything in the way of new material btit it does constitute the most comprehensive analysis to date of tangled affairs The principal thrust of the article is guilt by association Aside from the conspiracy conviction no proof is presented of wrongdoing on the part of Emprise Emprise Is Appealing Conviction The conspiracy conviction is being appealed by Emprise If It is upheld it could have many unpleasant reprecussions At present investigations are being conducted in Missouri Michigan and Louisiana to determine if long-time foe of Emprise claims the firm has Cosa Nostra ties Walter Kennedy commissioner of the NBA employed the Smith and Wesson Detective Agency to investigate Emprise Kennedy has said that if and against him In the case of the Kings it is significant that the Emprise corporation was convicted of conspiracy No individual charges were made against either Jeremy or Max Jacobs This indicates that the degree of the offense was considered to be minimal Sports Illustrated acknowledged this point in its article saying Los Angeles conviction could be viewed as a fairly petty no Emprise employee was indicted just the corporation In regard to the basketball franchise it is of further significance that the controlling interest is held by Jeremy and Max Jacobs personally not by Emprise The two brothers control an estimated 55 per cent of the stock Unless the hearings now being conducted in Washington turn up evidence of wrongdoing on the part of Emprise and the Jacobses themselves the A could make a reasonable case for allowing the present ownership to remain If the Kings are well supported in Kansas City it seems reasonable to assume the franchise will remain here regardless of what happens to Emprise and the Jacobses Should the NBA order the franchise to be sold presumably Kansas City interests would have a chance to purchase it In all probability it will be a year or more
