As far as is known to plaintiffs' attorneys, the members of that class are named in Exhibit attached to the original of this Notice. The plaintiffs in this action claim that the members of Defendant Class I are not entitled to participate in the distribution of the assets of Arizona Woolgrowers Association. This claim is made by plaintiffs asserting that the assets of Arizona Woolgrowers Association were nil before July 1, 1944 and Ihe members of Defendant Class I would not have been entitled to any distribution of assets had formal action been taken terminating their memberships.

Plaintiffs claim that the land which conslitutes the principal assets of the Association was acquired after July 1,1944 and that the members of defendant Class I did not contribute to the acquisition or preservation of the land. The Court has appointed Attorney John G. Verkamp, III, lo represent Defendant Class I. If you arc a Class I Defendant and do not make an appearance, you will be represenled by Attorney John G. Verkamp, III, and the Court will thereafter make orders which will affect your rights without any further notice to you.

These orders may include such orders as one establishing what interest, if any, you have in the assets of Arizona Woolgrowers Association or one adjudging that you have no interest in the assets-of Arizona Association. The plaintiffs in this action claim that only persons who paid dues to the Association are members, and that all persons who paid commissions to the Association or otherwise used the Association for the marketing of wool are not members and are not entitled to participate in the distribution of the assets of Arizona Woolgrowers Association. This claim is made by plainliffs asserting that the Articles of Incorporation and By-Laws of Arizona Woolgrowers Association provide that only persons who pay dues may be members and that the laws of the State of Arizona and the Articles of Incorporation and By-Laws of Arizona Woolgrowers Association provide for a distribution of assets of a cooperative marketing association only lo members of the Association. Attached to the original of this Notice is Exhibit which names the persons, now known to the plaintiffs' attorneys, who paid commissions to Arizona Woolgrowers Association for the marketing of wool but who were not members of the Association. These persons constitute Defendant Class II.

The Court has not appointed an attorney to represent Defendant Class II. If you are a Class II defendant and if no appearance is made in this lawsuit on your behalf, Ihe Courl may enter judgment by default determining that you have no claim to any portion of the assets of Arizona Woolgrowers Association. The Court has entered an order that all persons who are members of any class, plaintiff or defendant, must appear in this action on or before August 1, 1977, if they wish lo 1.
