Today Leavltt files his swar, and very straightforwardly stf that it was simply a speculative where no grain was handled, and nobody expect any to be handled. That it was simply a gambling transaction, and the amount sued for is simply what defend ant lost, and was therefore without consideration and void. For a further answer Leavltt asserts that between the 5th 23d of May, 1888, he paid the plain tiffs over 1,100 in this fascinating game. He asks judgment lor $1000 of this amount. S.

From the story It appear that the young man had purchased a bank in a small town In the state, and among the assets was a note for a larger amount than the law allows. On personally guaranteeing Its payment, the board suspended the rules. On Thursday, so the story goes, Howe secured by telling the deputy attorney generyl that the board had so ordered, a writ closing up the bank. It was closed, and the board la now investigating It.
