Cf Hrlnaly by tfca purui Board of Examination was given a push. i The meeting opened with all present except Director Redington, and the following communication from City Attorney Johnson was read Hon. F. ST. Campbell, Secretary Board of Education Dear Sir: In reply to your communicstiun of the 4th in.t.

I would say that, in my judgment, the Board of Education has the legal rigbt to make the necessary appropriation and allow warrants for the neeenary expenses of an appeal to the Suprema" Court from the decision of the Superior Court in the matter of teachers' certificates and City Board Of Examination. Ketpectfully, James A. Johnson, City Attorney: J. J. Xagle and F.

S. Monroe wanted to be school census marshals and their requests were tiled. The High school wanted a new curbing and Mr. Everett thought that it should be stone, in keeping with the new stone sidewalk. The matter was referred to the Committee on School-houses and Sites for an estimate of cost.

The following bills were allowed California Electrical Works, $8 20; Bart Morgan $3 75, $20, $20 92; de la MonUoiya, $40 75; W. B. Hardv, $19 20, $3 09: Pierce Co, $10 40, $15 90; Charles L. Taylor, $11; John Foley, Arper $160; Puget Sound Lumber Company, $38 25; Carl Kessen. N.

Krepper $3 50; James McPeak, $6. T. Stanton, $15; K. Davis. $10.

What should be done with the $10,000 Jlhat was bequeathed to the Board of Education by the late Antoine Chabot for application to the Cbabot Observ- atory has been worrying that body for some time. It is too little to do much with, and so the Observatory Committee that had the matter in hand, reported as follows First That as the gum named is inad-. equate to enlarge, the building and increase its usefulness and its appliances on a scale at all commensurate with QWiJeas of what should be done in view CI the foundations already laid; and Second In view of the fact that the bonds bear interest at the rate of 5 per cent, yielding an annual increase of to00, and also the possibility of Increase by donation, your committee would recommend that no portion of the lund shall at present be expended, but that the current which are very light in comparison with the benefits derived, be met, as heretofore, by warrants upon the General School fund. The plans had in view by Mr. Chabot for increasing the usefulness of his splendid benefaction and for increasing the valuable instruments already in use in the observatory and others to be added iu -a large, beautiful, and permanent building fi brick, stone, and iron, are already well -'ptnown to you, and it is also well known 'that had Mr.

Chabot been spared iu li fa and health such a building would now be approaching completion in accordance with plans prepared by request of Mr. Chabot and under the immediate direction and supervision of the directors of the ob- servatory, and his assistance and that of Professors Holden and Davidson. It is hoped, with some confidence, that the sum left by Mr. may be increased in some way to an amount sufficient to carry out his designs in regard to the observ- and thus an enduring monument be "erected to the raemoy of Oakland's most generous philanthropist and It is urgently recommended that the pres-. ent fund 61 $10,000 be kept intact, at least until every reasonable effort bag failed to secure so desirable a consummation.

A resolution by Mr. Everett adopting the report was adopted. As Mr-Everett presented the resolution there seemed to be some earnest conversation among the members and President Upham made an earnest demand that all vote on that topic. There was a sudden, startled, and spasmodic "aye" and all was silent. For awhile there was a war between twe rival photographers for the privilege at photograhlng the schools of this city, and th discussion became quite hot, more so than on any other matter before the board that evening.

The following estimate of the number of State text books that will be needed was presented by Superintendent Campbell: First readers, 1501 at 15 cents, $225; Second readers, 2200 at 30 cents, Third readers. 1500 at 40 cents, $G00; spellers, 4000 at 20 cents, $800; grammars, 2000 at 5JLcents, $1000; histories, 875 at 50 cents, $437 50; total, $4722 50. The Finance Committee was instructed to ask that the above fund be included in the Revolving fund of the county. This bronght tha board down to the matter of the Sixth ward school lot, and II. W.

Miller, the chairman of the committee that has the matter in charge, reported in favor of accepting the bids ot Koundtree Bros, and Mrs. Green-man. The lot of Boundtree Bros, is on the southwest corner of Fourth and garrison streets, is 100x100, for whijh $4100-is asked. Mrs. Greenman ha? a lot 50x100 next, which is offered for $2000, or $6100 in all, giving a lot 150x100.

"The committee was instructed to obtain permission from the Council to purchase the lot. "As we are under the head of unfinished business," Haid Dr. Fine, 'I move that a matter that has been unfinished for over a year be taken up, and I move that Mr. Remillard's bid of $100 for constructing a vault at toe Franklin school be accepted." There wai some discussion as to whether the work could be done any cheaper at present, but as lime and bricks have both risen in price since the bid was offered there seemed no prospect of a cheaper bid and tbe contract was awarded. The old matter of testing the legality of the abolition of the City Board of Examination was brought up by Mr.

Smith, who moved that a committee of three be appointed to take charge of -i matter. Messrs. Smith, Miller, and Fine were appointed. Miss A. M.

Youngman of the Pres-cott school was granted a vacation until the end of the term. Just before the adjournment Mr. Dnnn of tbe evening school reported that the school opened last evening wifb fifty-nine pupils, twelve of whom are new pupils, and only forty-seven were old scholars. At the close of school the register showrd eighty-eight pupils. The board then adjourned.
