News STATEMENT LINCOLNTON. N. C. . THURSDAY, JULY 13th, 1922 Negro Waiter Attacks Girl. Birmingham, Ala., July 2. W. E. Hayes, negro waiter on the Louisville and Nashville train No 3, en route from Nashville to Birmingham is in jail here tonight on the charge of having attempted to criminally as-sault a prominent young woman of Montgomery, Ala., who was a passen-arer on the train today. The negro was removed from the train when it arrived at the station here by local officers, after telegraphic instructions from Cullman, where the alleged crime is said to have been attempted. According to Conductor S. H. Cook, the negro, who was serving patrons of the dining car at lunch, was cleaning off the tables just , before the train left Cullmgan. Being the last person to leave the diner, the young woman was 'followed by Hayes to the rest room. Just as the passenger closed the door behind her, the waiter forced himself into the compartment, but was repulsed. Upon a second attempt he forced himself through the door by throw-. ing his body against it, and ; was scuffling with the young woman when Conductor Cook rescued her. Hayes is said by local officials to have denied that he laid hands upon the woman, but admitted that he forced his way into the rest room after the passengers had left the diner. The negro is being carefully guarded in the Birmingham jail and will be turned over to Cullman authorities tomorrow. The young wo man stated that she will appear to push charges against Tayes. Mentioning the progress in build ing the highway from Wilmington via Charlotte, Gastonia, 'Shelby and Rutherfordtoh to Asheville, the Char lotte Observer remarks that "the hopes of . the State for " an all - hard surfaced highway from sea to the mountains are therefore rapidly on the way to realization. It may also be remark ed that the hand-surfacing of the State Central Highway, the original line projected from -the Tennessee line to the coast, is not proceeding in such wav as a good portion of the State could desire, simply because the State Central Highway is not so fortunate as to run by home towns of highway commissioners in this end of the State -Statesville Landmark.
