interpretation of a law enacted in June the responsibility for Upgrading By Maureen Connolly Associated Press Writer AUGUSTA Maine (AP) Six state employes filed a suit Friday charging they and 468 other state workers have been told qualified for higher salaries but not getting the uav The six filed the class action in US District Court in Portland with the help of the Maine State Employes Association The action names State Personnel Director Nicholas I Caraganis State Personnel Board Chairman Kenneth Robinson and four other Personnel Board members According to the suit the 474 employes have been told they are qualified to move up at least one pay step in the state personnel system Several of the employes are entitled to range changes which is an increase for all employes within one classification such Clerks and due process guaranteed by the 14th Amendment of the Constitution are being violated MSEA Executive Director David Carnevalc said is indeed an unfortunate situation when the governmental leaders of this state must be dragged into court to be forced to meet their legal obligations to state The six employes filing the action are Duane Newman a mechanical stores clerk Kenneth Bradstreet a license examiner George lawlor a disabilities claims examiner Claire Gravel a motor-vehicle clerk Fidele Iimontagne an Augusta Mental Health Institute cook ana Kenneth Dare an electrician Other Personnel Board members named in the suit are Laura Nawfel Crystal Pomroy Patrician Ryan and Harold Gosselin 6 file suit challenging rules on pay employes and raising their pay rests with the ture The MSEA said Friday the legislature failed to act on step increases for the 'employes during the regular session The legislature voted instead to study the state personnel system and the classification system in the coming year As a result of the administrative inaction the employes said they remain at lower classifictions doing the same the work as their fellow employes in higher
