Sapulpa Okla Herald, Thursday, April 30 1987 PAGE FIVE Hassle delays house vote on juvenile centers OKLAHOMA CITY AP Final action has been delayed on a House bill that would require counties to put juveniles into separate facilities from adults after an argument over transportation costs broke out in the Oklahoma House The bill, which has passed the Senate, would require counties to participate in a statewide plan for facilities for juvenile offenders That plan calls for regional facilities in Tulsa, Oklahoma City, Lawton, Shawnee and Durant The issue of how counties would pay for transporting juveniles to the regional facilities was the basis Wednesday for a debate between Reps Loyd Benson, D-Frederick, and Jim Glover, D-Elgin Rep Steve Lewis, D-Shawnee, agreed to delay the final vote until the transportation costs issue was resolved Benson said no one in the Department of Human Services, which is developing the plan for the juvenile detention centers, had told him who would pay for transporting youths to the regional facilities Glover, however, said the DHS intends to participate in a program with the federal government under which the transportation costs would be paid out of federal funds I thought DHS was going to come back with some written policy, Benson said They have not met that responsibility I don think we ought to do anything until we see something in writing Glover said he had been told by DHS officials that the provision for the transportation costs had been arranged Any way, the transportation cost is negligible when compared to the cost of lawsuits filed against counties for having juveniles in the county jails, Glover argued Rep Jim Hamilton, D-Poteau, won adoption of an amendment that would allow counties to keep juveniles in local jails certified by the state Department of Health, which inspects jails Hamilton said juveniles shouldn't be hauled up to 200 miles to a regional detention center if there were adequate facilities in the local community He said it was far better for a juvenile to be in a local facility Bowl of Corregidor fame due in state OKLAHOMA CITY AP When members of the 31st Infantry Regimental Association gather in Lawton for their reunion in the middle of June, they ll drink a toast from the Shanghai Bowl And Carl Sharp says he hopes he ll be there It if hadn't been for the 74-year-old Sharp, who now lives in Atlanta, there might not be any Shanghai Bowl at all It was in April 1942, with the Japanese army advancing and shells falling nearby, that a special detail under Short, then a captain in the 31st and an aide to Gen Douglas MacArthur, set out on Corregidor in the Philippines to hide the massive silver bowl and its 65 matching cups It was a beautiful thing, Short said Wednesday It was kept in a highly polished mahogany box with drawers and doors and had a ladle and a teak wood base I had a system of trenches on the side of a hill, Short said I took two of my men, swore them to secrecy, and we dug a deep hole in the bottom of one of the trenches He said the bowl and its cups were coated heavily with Cosmoline, a petroleum product normally used to protect weapons, then packed in sawdust inside a galvanized iron box That box then was placed inside a wooden box, which was buried in the hole The two men who helped me do it were both lost in the war, said Short, who survived the Bataan Death March and nearly four years in Japanese prison camps When Short was freed in 1945, he said he went to Gen George Marshall and told him of the buried bowl He told me I better go and get it, Police issue advice on defending self Short said He furnished me with a detail of about 10 men and shovels I pretty well knew where it was, but the hill had taken such a pounding from shells and the mbble had rolled down so you couldn tell if you were three feet deep or 30 feet deep After about a week, Short said, he went back to Marshall and said he couldn find the bowl He arranged for an Engineers Company with heavy equipment to take over the job, Short said Late in September they found the bowl in perfect condition I wasn in the Philippines when they found it Late Tuesday, another detail returned from Korea, taking the bowl and its cups to Fort Sill in southwestern Oklahoma They were uncrated Wednesday for display in the trophy case at the 31st Infantry Regimental Headquarters It the first time in its history that the bowl has been on American soil, Alan Hancock of Sunset Beach, ed the counter with four cartons of cigarettes and demanded that Hayden hand over all the money from the cash register Hayden refused and fought with the man until police arrived and found that Hayden had forcibly subdued Hamilton Moss said Hayden acted within his rights to stop an assault Omdorff said Hayden took a chance by resisting, because police believe another person was waiting outside and could have entered the store to help his partner Police do not keep statistics on the number of times citizens act to defend themselves, Omdorff said, but he thinks the incidents are increasing Moss said he does not think criminals have been deterred Ask a car thief if he afraid of being shot, Moss said Probably not, because it doesn happen often near his family than to be sent elsewhere However, Lewis said jails are not the place for juvenile offenders, because they are housed with adult criminals and are abused in ways you and I can begin to think of In other action, the House passed a bill that would permit independent voters to cast ballots in party primaries at the request of party chairmen Rep Glen Johnson, D-Okemah, said the Supreme Court ruled in 1986 that stales could not prohibit independents from voting in party primaries Johnson said that under the bill, state party chairmen would notify the state Election Board that they would allow independents to participate in their party primaries What we re doing is setting up a procedure for the parties to allow independents to vote if the parties want them to, he said But Rep William Veitch, R-Tulsa, said candidates could easily lose an election if a group of independents backed a particular candidate That might not mean much to you who won by large margins, but in races where the winning margin was 50 votes to 100 votes, you could easily lose, Veitch said Rep Wayne Cozort, R-Tulsa, said it was totally ridiculous to allow independents to vote in a party primary when they don support that party financially or voluntarily The House also voted to add a repeal of the prevailing wage law to a proposed constitutional amendment dealing with school building funds The proposed constitutional amend ment, which would have to be approved by voters, would raise from 5 mills to 10 mills the amounts school districts can levy for school building funds The prevailing wage is the average of wages paid within a given area of the state on public works projects Two years ago, legislators changed the law so that public projects under 600,000 would be exempt from the prevailing wage requirements The House also passed a bill that would allow wildlife rangers to search game bags, livewells or boats of sportsmen if they have probable cause to believe that people have taken wildlife illegally TULSA AP Although some people are willing to fight back when attacked by criminals, police are issuing words of caution in the wake of incidents this week in which two Tulsa residents didn buckle under Police prefer that citizens avoid confrontation, try to get a good description of the lawbreaker and call authorities for help, said Lt Randy Omdorff, spokesman for the Tulsa Police Department I don like to second-guess anybody, but people go out and buy guns and hardly know one end from the other, Omdorff said David Moss, Tulsa district attorney, said citizens have a right to defend themselves, their families and property against felonious crimes, without fear of prosecution from the state I certainly don want to stop people from defending themselves, he said But I don want to encourage people to start blasting away any time they want Jutta French, who fired at an intruder in her house, said she and her husband had returned home Sunday evening when a man surprised them in the garage Her husband, James, struggled with the intruder, while she went into the house for a gun The attacker ran into the house and Mrs French shot at him Police said one bullet apparently struck the man, who fled on foot I never shot a gun before in my life, Mrs French said But I was scared to death for my husband sake Moss said he knows of no prosecutor who would file charges against Mrs French and others who fire at intruders in their houses If he coming in the window, I not going to ask any questions of a resident who responds, Moss said Unfortunately, sometimes it works out that someone is killed accidentally as a result Moss said once an assailant flees, the citizen legally may not shoot him You re not in any danger anymore if he running away, Moss said You can say, Well, I was afraid of my life so I shot him at 30 yards in the back of the head Omdorff said he did not want to criticize Mrs French judgment, but said he would warn residents in a similar situation to try to get away from the intruder Rodney Hamilton, 19, was arrested and charged with robbery, officials said Police said Rogeis Hayden, a convenience store clerk, won a tough fight early Tuesday morning with a man who tried to rob the store Hayden told police a man approach- Texas, president of the 31st Infantry Regimental Association, said Wednesday Hancock was one of the present and former members of the unit who went to Korea to return the bowl It was the first time I had seen it since Aug 13, 1941, said spokesman said the bowl, 30 inches across by 21 inches deep, was made in 1932 by a Shanghai, China, silversmith from 1,500 American silver dollars It and the cups were purchased for 1,600 donated by the officers of the 31st Infantry when the regiment was sent to China It has always been kept at the headquarters, and the headquarters has always been overseas, said the 71-year-old Hancock, who also survived the Bataan Death March and 44 months as a prisoner of the Japanese Jerry Francois, 58, of Fountain, Colo who fought with the 31st in Korea during the Korean War, also made the trip to bring the bowl to the United States He said he had drunk from the bowl on regimental celebrations, such as changes of command and the anniversary Over the years, Francois said, officers bought their own cups for the bowl, and sometimes they go partners in one There is supposed to be over 200 cups, but some apparently got lost as the bowl was moved around from place to place because there are only 101 now The Shanghai Bowl had been at Camp Howze in Korea But under the Army reorganization, the 1st Battalion, 31st Infantry in Korea is becoming the 1st Battalion, 5th Infantry and had to give up the bowl It had been a regimental treasure in Korea for three decades Those boys over there, they re not very happy about losing the bowl, Hancock said You ve got to realize just what it means But I told
