jury TOPEKA, Kan AP Jurors in the Koch trial have S4 pages of instructions to help them sort through It weeks ol evidence and testimony, and what they need to consider when they render a verdict Jurors began deliberations Wednesday morning on the complex case of four multimillionaire brothers locked in a dispute over a stock sale 15 years ago Two Koch brothers are leading a group of plaintiffs accusing two other Koch brothers of cheating them in the sale A group of dissident shareholders, including Bill and Frederick Koch, sold 5 5 million shares of Koch Industries stock at 2 apiece That group now claims the company withheld information about its plans for expansion at the Pine Bend refinery in Minnesota They claim the stock was actually worth 262 a share While the plaintiffs claim they were cheated in the stock sale, the defendants contend that Frederick and Bill Koch had ample evidence that an expansion of the Pine Bend refinery as going to occur Among the instructions are that plaintiffs must not onl prove they relied upon what they were told before the stock sale, but also that they were justified in doing so The plaintiff cannot intentionally close their eyes and refuse to investigate the circumstances in disregard ot known or obvious risks, the instructions read Instructions further say, When a plaintiff actively doubts the defendants disclosures, insists on written warranties to offset those doubts the plaintiff cannot be said to have relied upon the defendants' misrepresentations or omissions, Charles Koch, the president and chief executive officer ot Koch Industries, gave the shareholders a warranty It took District Judge Sam Crow and his court clerk more than an hour to read the 56 items ot instruction, which recapped the main points of the case and the points of law surrounding it Jurors followed along, using copies they had been supplied I hev were also given a 16 page verdict form, on which they will indicate whether they believed the plaintiffs or the defendants Jurors must find which, it any, of the defendants lied about the Pine Bend refinery expansion or withheld information about it It the jury finds information was withheld or misrepresented, it must decide whether that fact made anv difference in the stock sale, including the price Jurors must also decide whether Koch Industries paid a fair price lor the plaintiffs stock, and what damages, if any should be paid According to their instructions, damages must be the difference between the shares' fair market value and what plaintiffs were paid Plaintiffs are claiming damages totalling 336 million The plaintiffs are seeking punitive damages as well Jurors also will determine whether punitive damages should be awarded, but an amount would be determined in separate proceedings Plaintiffs in the case are Bill Koch and his holdings holdings of the Simmons family also dissident shareholders, and Frederick Koch's holdings Defendants are Koch Industries Inc Chailes Koch David Koch and other executives Jurors were instructed to use only evidence and testi- monv in considering their decisions not the number of witnesses on either side or implications attorneys may have made during testimony They were told they should determine whether witnesses were credible, and may accept or reject the testimony of any witness Jurors were officers hurt, man arrested KINGFISHER AP A man was in custody after allegedly running over a police officer in Del City and later crashing into an Oklahoma Highway Patrol cruiser in Kingfisher Robert
