right to be tried by an impartial jury does not entitle a white defendant to have blacks serve as jurors deciding the accused fate But the justices, sharply divided over the issue, indicated that in some future case they might rule that excluding blacks as jurors does discriminate unlawfully against white defendants Those seemingly contradictory conclusions were spelled out Monday in the case of Daniel Holland, a Chicago-area white man sentenced to 85 years in prison for rape, kidnapping and armed robbery He was convicted by an all-white jury after prosecutors ban-ed the only two blacks among more than 30 prospective jurors from serving on the panel In other action, the court Sent a new signal it will permit widespread, random drug testing for government workers even when public safety is not at stake The justices, without comment, refused to interfere with random drug tests for some Justice Department employees and civilian Army drug and alcohol counselors Ruled, 6-3, that lawyers in the nation capital violated antitrust law when they went on strike to demand higher pay from the city for representing penniless criminal defendants Agreed to use a North Carolina case to decide whether nuclear industry whistle- blowers who say they were disciplined for complaining about lax safety may sue under stale personal injury laws Said it will decide in a decade-long Haitian refugee case when the government must pay legal fees to people who sue it successfully The court will hear a Bush administration appeal aimed at limiting the fees Voted to study a former high school wrestling coach 15-year-old libel lawsuit against an Ohio newspaper At issue is how courts are to distinguish between fact and opinion in libel cases In the Holland case, the court voted, 5-4, that his Sixth Amendment right to be tried by a jury representing a fair cross-section of the community was not violated Left unanswered is whether Holland or any other white defendant 14th Amendment right is abridged when prospective jurors are excluded because they are black The 14th Amendment guarantees equal protection under the law, broadly prohibiting racial bias Justice Anthony Kennedy, who voted with the majority Monday, said he might switch his vote if the issue is 14th Amendment protections I find it essential to make clear that if Holland claim here were based on the 14th Amendment Equal Protection Clause, it would have merit, he said Holland had not asked the high court to consider the 14th Amendment issue in his case The justices in 1986 ruled that when prosecutors disqualify potential jurors based on their race it violates the 14th Amendment ban on discrimination But that case, involving a black defendant and black jurors, applied only to instances in which the defendant and the jurors arc the same race The court never has said whether unlawful racial discrimination in jury selection occurs when the accused is of a different race than the excluded jurors The 1986 ruling dramatically curtailed the traditionally broad power of prosecutors to eliminate prospective jurors from trials by using peremptory, or automatic, challenges Justice Antonin Scalia, writing for the court in Holland appeal, said, Race as such has nothing to do with the legal issue in this case Holland Sixth Amendment claim would be just as strong if the object of the exclusion had been, not blacks, but postmen, or lawyers, or clergymen, or any number of other identifiable groups, he said Farm food stamp rules change OKLAHOMA CITY AP A rule change approved by the Oklahoma Commission on Human Services will allow more farmers to be eligible for food stamps State officials, however, say they don expect large numbers of farmers to begin applying Glen Wallace, coordinator of rural mental health programs for the Department of Mental Health and Substance Abuse Service, said that even with the new policy, few farmers will apply for food stamps He pointed to their pride and their disillusionment with government as the reasons It will open a door, but I don think you will have a run on food stamps, he said Monday The commission, which oversees the Department of Human Services, approved a change to exclude farm land and work-related equipment as assets in determining food stamp eligibility for self-employed farmers DHS director Phil Watson said the highest number of Oklahoma farm households receiving food stamps at one time has been 12 Wallace said many farmers although deep in debt have been unable to qualify for public assistance because land and equipment were considered assets Many farmers in the past were discouraged from applying for food stamps because of the criteria concerning land and vehicles, said Tom Self, associate director of policy analysis at DHS Also Monday, the commission voted a Si per day increase for child care providers who serve DHS-subsidized children Low-income families arc eligible for day care assistance through the DHS The DHS now will reimburse child care providers 10 per day for school-age children in full-time care, SI 1 pa day for preschoolers and Si2 per day for infants and toddlers The vote to raise the reimbursements came after the commission was presented a report outlining some of the problems with the existing system A legislative task force, led by Sen Vicki Miles-LaGrangc, D-Oklahoma City, and Rep Vickie White, D-Norman, held hearings statewide last year to examine the needs of the child-care system FBI searches for mail bomber ENTERPRISE, Ala AP FBI agents investigating the mail-bombings that killed a federal judge and a civil rights lawyer searched the salvage business and home of a man who lost an appeal before a panel that included the judge A published report today indicated the agents may have been looking for a typewriter used in letters from the bomber A relative of the man whose property was searched said FBI agents asked family members about an old typewriter, but the agents did not say why Robert Wayne Ferrell was questioned most of the day Monday, and agents with bomb-sniffing dogs searched his sprawling Enterprise junk warehouse, a smaller junk shop, and his home in nearby New Brockton, about 75 miles from Birmingham Police and a bomb squad from a nearby Army base joined the search No charges were filed against O'Fcrrcll or anyone else, agent Chuck Archer of Mobile said Agents suspended their search at about 10 and police scaled Fcrrcll property O'Fcrrcll, 46, described by a neighbor as a former Baptist preacher who once sold insurance and took up the junk business her father, who disappeared in 1947 My phone rang from late Wednesday the night of the show until Saturday, Carol Solstad said Officials with the program, Unsolved Mysteries, told her they took more than 250 tips and got thousands of phone calls after airing the segment on her father Ray Curtis Hickingbotham, a lieutenant in the Army Air Corps, was working in radio intelligence for the Army Security Agency at Vint Hill Farms Station and Arlington Hall Station, Va when he failed to return home one October day Through the years, Solstad has heard numerous accounts of his disappearance, including the government claim that he deserted She refused to accept the government answer and began her own investigation In 1987, after an article about her father ran in an Arlington, Va newspaper, Solstad said she received a phone call from a man who claimed to be a former member of the Central Intelligence Agency The man said he knew her father and that in 1947, her father was forced to change his name and not allowed to return home for his family safety The caller said he learned of Hick- ingbotham secret in 1959, when Hickingbotham best friend died He essentially said my father was a good man and that he was using the name Nelson, Ms Solstad said He also said my father worked in the Middle East Although the man promised to call back, Solstad never heard from him again But after Wednesday television program Unsolved Mysteries reported receiving two phone calls from men who claimed to be former CIA members The men relayed much of the information Solstad received from the 1987 caller Solstad also said Unsolved Mysteries told her the FBI on Friday requested transcripts of the phone calls taken on the Hickingbotham case When officialsof the program refused, FBI members said they would subpoc na the transcripts, she said During her search, Solstad said that when she contacted the FBI, they had no record of her father disappearance Other callers claimed to have seen her father in a specific area in Europe, and teaching school in El Paso, Texas I still don know what the truth is, she said I find it far-fetched that my father still can come back after all these years I ll just keep searching Treaty figures in Tulsa drug trial TULSA AP Attorneys on opposite sides of the Jose Rafael Abello-Silva drug conspiracy case have differing opinions on the details of a treaty that could have a bearing on the case Attorney Tony Graham disclosed Monday that an extradition treaty between the United States and the Republic of Colombia sets a 30-year prison limit for any extradited Colombian citizens convicted in American courts At a court hearing, District Judge Thomas Brett said drug conspiracy laws provide for a maximum sentence of life imprisonment But under the provisions of the treaty, he said, the maximum the court could impose is 30 years in prison if Abello is convicted Graham said the judge could impose a larger sentence to ensure that Abello would serve the 30 years without being eligible for parole But defense attorney Richard Racehorse Haynes of Houston said that was absolutely not his understanding of the treaty He contended the court could impose only 30 years, which would mean Abello might be eligible for an earlier release on parole Abello, 35, of Santa Marta Colombia, will face jury trial March 13 on drug conspiracy charges Federal authorities believe Abello is the No 4 man in the Medellin drug cartel He is accused of conspiring to smuggle thousands of pounds of marijuana and hundreds of kilograms of cocaine into the United States Haynes argued Monday that his client was being illegally detained because he was not extradited on the charges he now faces That issue will be addressed at a hearing Feb 14 Haynes also said he was not prepared to argue for Abello release on bond because he has not received from federal prosecutors documents that the government used to extradite and indict Abello Graham said he received some extradition records Monday He presented the sealed documents to Brett, who is expected to rule by Wednesday what materials defense lttomeys are entitled to receive.
