Martin, Wilcox Block, for the purpose of nominating candidates for the positions to be filled at the charter election on Monday next. The convention was called to order by attorney W.Vaa Voories, who nominated for Chairman J.

West Martin. Attorney J. R. Glascock was nominated and filled the position cf Secretary. Tht President stated, for the benefit of those unacquainted, that this was an adjourned meeting from last Tuesday evening, and that they now had come together to make public a Citizens' ticket to present to the voters of Oakland.

He desired to hurry along the business of the Convention, and at once called upon the Committee appointed at Tuesday's meeting to select ticket to report. Said Committee, which was composed of V. P.Terry, Joseph Becht, Asa Howard, J. C. Martin, J.

R. Glascock, Bod Gibbons, S. Hershberg, and the Chairman, reported the following crnzxNs' ticket. For Mayor Hon. W.

J. Gurnett. For Councilman First District, S. Hirshberg; Second District, S. Dods; Third District, J.

W. Pearson; Fourth District, Asa Howard. For the short term, Thomas Yollaad. For Board of Education First District, Dr. B.

E. Cole; Second District, W. K. Bo well; Third District, C. C.

Braun; Fourth District, Asa Swett. For the short term, Second District, E. B. Marsh. For Clerk and Treasurer H.

Hille-brand. For Assessor J. Dillon. The Convention received this report, took up each nomination separately, and unanimously approved of it by acclama-mation. J.

C. Martin' then congratulated the Convention for its wise selection of candidates for city officers, and offered the following resolution, which was unanimously PiBTT XJNIS DtaCOCBAGBD. rebels. It la to be for the best interests of the city of Oakland, in administering its local attain, to eaeonaage unity and harmony among all her citizens, snd to discourage the drawing of party lines and the nomination of partisan candidates for municipal offices in party convention, distinguished only fur flippant resolutions on the grave question of national politics; therefore, Rnolred, Thst the candidates named are presented for the various offices to be filled at the approaching municipal election nert as partisans biased in favor of or prejudiced against any class of their fellow citizens, but as men who, if elected, will use their official station honestly for the benefit of the city rather than of party, and for the advantage of all citizens alike rather than for a portion. We came back to the house, I asked my wife for a glass of water; Mrs.

Gieschen came out, and said she didn't want scrapes about the house; I sot excited: couldn't help myself; and I didn't know what I did. Hanson said he could have shot her before, as he had bad opportunities. He said he bought the pistol in San Francisoo last week to take his own life. This closed the testimony, and the Court ordered him to appear before the County Court, with bail fixed at $15,000. The imprisonment for an offense of this nature is from one to fourteen years in the State Prison.

Ere this, it is a matter of legal record, that the big suit between Captain Wilcox and Doctor Merritt, over the Grand Central Hotel, has been finally and forever settled. The Captain is now sole proprietor of the institution, including all the dips, spurs and angles, and will probably make a new deal in and around there at an early day. Every well-wisher of Oakland will be glad to hear that the matter has been settled somehow, and that so important an institution as the Grand Central, as respects the cjtys prosperity, will be no longer clodeoH)yiancOnn1ct of owner ship.

T. Hurll was convicted in the Police Court of selling liquor without a license. An appeal was taken, to the. County Court, wher the case was argued and submitted. Yesterday Judge Nye rendered the following decision: The People vs.

JVai, T. Hurll. This is an appeal from a judgment of the Police tkiurt of the city of 4Hklaa tor the Ttolatloa of an ordi-nance whic jirovides that "all persons who and dispose of any sptrituons, malt or fermented lirpaors or wine in less nnantitiee than one quart, whose proceeds are less than per quarter" shall pay a license of $30 per quarter; and failing to pay, shall be punished. The principal point of argument is that the ordinance is void became the rate of the license Is extortionate, the ordinance was intended to suppress the retail liquor trade and must hsve that effect as to some dealers, and because the city through its legislative department In so doing exceeded ita charter The powers of a municipal corporation are restricted to the grant contained la its eharters. This is elementary law, and so well dad ani-fonnly settled that Its renunciation is sufficient without citation of authorities.

What are the charter powers the city of Oakland? Reference herein is made to the charter and the multitudinous amendments and revisions ss collated In the Oakland Directory for 1874. Sec. 1st, page 310, grants power to suppress certain kinds of business, of which the retail liquor trade is not one: Sec. 6th, -page H. grant to the Council the exclusive right in too manner prescribes by ordinance is issuing and granting of license and of collecting the taa licenses for the benefit of the city upon certain kinds of business, enumerated among which areaU per-sons who may sell and dispose of any malt, spirituous or fermented liquors or wines in less quantities than one quart.

Sec. Aid, page 829, provides: "Licenses shall be discriminating and proportionate to the amount of basiness." It is conceded that the true construction of the Isst section to that the several kinds of business shall be classified; snd the amount of Ueense shall be proportionate to the amount of business done. The charter gives power to license and to fix the amount. But, says the appellant in this case, the amount fixed ia oppression snd prohibitory of the trade licensed. To some extent tha aame may be aaid of any license.

The ordiuauce is a legal exercise of charter power, and validL The further point is made that the statement reveals no admission or proof of the existence of the ordinance In question. The point is well taken. An ordinance is not, like a statute, the subject of indicial ognizance without proof. The defendant was therefore illegally convicted.
