He said it was possible the Legislature could strip his department of the health regulations currently on the book merely by changing the statutes and superseding its authority. Aiken said. Next thing we knew, ice cream inspection was placed under the provinc of the Agriculture Department. Moulton said Wednesday that the Health Department has enough to do at the present time that isnt being done. School plans are gathering dust Moulton said. The Health Department has to give preliminary approval to school building plans according to sanitation regulations.

He also suggested other Health Department inspections were being curtailed because of its. in-' volvement with overseeing health regulations. Dr. Aiken has admitted in the past that his department is short staffed. He has asked for more personnel, rather than less authority, to answer the problem.

The health commissioner also added that small communities were ill-equipped to spot the first signs of possible health problems in the making. It takes a trained epidemieolo-gist, Dr. Aiken said, to spot the danger signals. Cutts said Wednesday the problem was one that Environmental Control Commission and governors office would have to work out. He said there apparently wasnt a consensus between the two before, although the Environmental Control Commission which has expected to introduce conservation legislation directly into the legislative hopper has now learned that the rules, if not changed, are not what they thought them to be originally.

The Environcental Control bills, at least those that deal with land development, will get the administrative touch before landing in the hopper. While Orr, Gibb, Blucher and Hansen are all members of the Environmental Control Commission, Moultons presence on the drafting team means the bill will be tailored to what Gov. Davis nil! accept as practicaf to get through a General Assembly and convince the public that he has taken a broad first step on conservation controls. Deane C. Davis may be backwa-tering on strong environmental control legislation surfaced Wednesday less than a week after the governor had made an impassioned speech to preserve Vermont before the General Assembly. Rep. Arthur Gibb, R-15 of Wey-bridge, chairman of the. Environmental Control Commission, was told he had done a nice job cataloging the environmental control legislation needed by the state.

But Gibb was also informed by Special Gubernatorial Aide Elbert G. Moulton that the administration not the commission would whip the bills into final shape for presentation to the Legislature. The confrontation occurred Wednesday morning in the House Natural Resources Committee room while the rest of the Legislature was in session. Meeting with Gibb and Moulton were Committee Chairman Royal B. Cutts, R-72 of Townshend, Assistant Atty.

Gen. John Hansen, Environmental Commission Vice Forrlst Orr, Montpe-. tier City Manager Warren Scrib-; ner and Sen. Arthur Jones, R- Orleans-Essex. Moulton said after the meet- ing that the commissions job was to make recommendations to the governor.

Aiken, state commissioner of health, agreed Wednesday that legislation could be developed to supersede the Health Department regulations on development. But Dr. Aiken said he didnt feel the primary responsibility for protecting the general public health of Vermont and its citizens should be taken away from the Health Department. Dr. Aiken said he would announce shortly the appointment of an advisory committee, made up of developers, sanitary engineers and laymen to review the Health Department regulations.

The committee may be merely academic after the administration whips conservation legislation into shape that will all but bury the Health Departments regulations. The home buyer has to have some kind of protection when he buys, a lot. Dr. Aiken said, and the responsibility belongs to the developers and builders to guar-ante that ones home is not going that the state has been reimbursing hospitals for bills accrued by the poor, Philbrook said the payment has amounted to a total of only $40,000. Philbrook said that some hospitals had not sent their bills in yet, but indicated that the first three months experience pointed out that the expense was not going to be as great as originally anticipated.

Philbrook said that the way things stand, the department may now have enough money to get through the year. Im not predicting a surplus, Philbrook said. But he added that some increased federal receipts had things looking much brighter than the original doomsday prophecy voiced by Simonds last year. Philbrook said his department had requested a 15 per cent increase for fiscal year 1971 over the $1.25 million originally thought to be needed to meet fiscal 1970 hospital general assistance costs. This request had been made last September before the hospital bills started to flow in.

Philbrook smiled and said he didnt expect the department would now receive that much since, the hospital costs had not run nearly as high as originally expected. It (the budget) will have to be revised, Philbrook said. But what about that huge million deficit? Philbrook was asked by reporters. Those werent my estimates, Philbrook chortled. Remember? Mohawk Will Begin Burlingfon-Boston Jef Service Feb.

I VERMONT PRESS BUREAU Mohawk Airlines will inaugurate non-stop jet service between Burlington and Boston on Feb. 1, coinciding with Northeast Airlines termination of service between the two cities. Gov. Deane C. Davis said Wednesday that he will participate in the opening day ceremonies at Burlington Municipal Airport scheduled to coincide with the 3:30 p.

flight. Mohawks maiden flight will leave Burlington Municipal Airport at 7 a. m. on Feb. 1 with landing scheduled in Bos-toh at 7:40.

The carrier will be a 69-passenger, BAC 1-11 jet. Mohawk will run three flights daily, a 7 m. Early Bird flight, a 3:30 p. m. flight scheduled to land in Boston at 4:20 p.

m. and a 7:40 p. m. flight that arrives in Boston at 8:20 p. m.

The mid day flight will be via a 44-passenger Fairchild jet. The return trip schedule, Boston to Burlington, begins with a 9:30 a. m. daily flight from Logan Airport arriving at Burlington at 10:30 a. a 6:30 p.m.

flight that arrives in Burlington at 7:10 p. and a final 8:45 p. m. flight that gets to Burlington at 9:25 p. m.

There will be no increase in present Northeast fares, a Mohawk spokesman told Gov. Dais. The governor said the Mohawk schedule represents a 50 per cent increase in daily passenger service compared to the Northeast schedule though planes will no longer land at the Barre-Montpelier Airport. Northeast, at the present time, plans to continue its weekend East-West service to Cleveland and th ywamnr said. Included in the regular agenda for the business meeting will be a discussion of regulations and codes, including subdivisions, building, housing, etc. Bill Would Apply Fair Housing law To Nursing Homes VERMONT PRESS BUREAU A bill which would bring religious-related institutions and non-profit nursing homes under the provisions of the Fair Housing Act of 1967, passed the House Wednesday and was messaged to the Senate. The bill ran into no opposition in the lower chamber despite the fact many of the present members worked in opposition to the Fair housing law three years ago.

If the bill passes the Senate and becomes law, religious institutions will be prohibited from discriminating against applicants for reasons of race, color or creed. Also passed and sent to the Senate was a bill which would make trespassing a criminal offense, rather than a civil one. The measure had sparked considerable opposition in the lower chamber Tuesday but was advanced by a large margin. The bill was passed last year by the Senate, but the House made a minor amendment so it must go back tq the Senate for final approval, Under the tertns of the proposed law, a land owner could call the police to have a trespasser removed from his property. The penalty for trespassing would be a $100 fine.

Another bill which was passed by the House and will go to the Senate amends the medical registration law to provide for an examination fee of $100, an increase of $25 and would give the board authority to use multiple choice questions as well as essay questions in the examinations.
