jury indictment of beating Edward Chevlin a former teamster official Testimony began before Judge Cook after Ring waived a trial by jury Chevlin objection to answering a question at one point in the strike because they refused to work under terms of the old contract The bricklayers however maintained that they w'ere locked off the job because the contractors cut their w'ages to $325 an hour associated with the Mutual Broadcasting system Surprise in WHB Sale While there had been rumors for some time that the Midland company' might be sold to Cook the announcement of the sale of the WHB Broadcasting company to the Omaha interests was a surprise But FCC regulations provide that not more than one radio station or one television station may be owned or operated by the same party in one city It was necessary therefore for the Cook Paint Varnish company either to dispose of its radio properties operated under the WHB call letters or dispose of facilities now operated by Midland The preliminary' arrangements were conducted primarily by Caldwell a lawyer who represents the WHB Broadcasting company in legal matters and the Washington counsel of both Cook Paint Varnish and the Mid-Continent company7 The Washington firm representatives here were Paul A O'Bryan and Francis McDonough The agreements for both transactions were signed about 7 o'clock last night in Caldwell's office in the Federal Reserve building Under Call Letters Under terms of the WHB agreement the equipment contracts for sale of radio time and radio accounts receivable of the station will be turned over to Mid-Continent It is expected the property will continue to operate under the WHB call letters The complications of sharing one television channel was reported to be a prime factor behind the sale of the Midland properties to Cook Since last August 3 KMBC-TV and WHB-TV have been sharing channel 9 with programming shifting from one station to the other In connection with this situation Backstrom and Church said in a joint statement: "We have learned that sharedtime operation of a television channel can be successfully accomplished but w'e have learned also that the difficulties of was given after hearings by the commission At the beginning of deliberations on the Curry project Stultz said he was in favor cf it but did not believe he should vote in view of his interest in his own project However other members told him that he should vote on the matter as long as his own property w'as not involved Philip Geissal chief planning engineer said he believed the Curry plan was too ambitious and suggested that the technical staff be given time to study the proposal further with a of reducing the plan The commissioner members including Stultz took the position that the matter of business competition would determine the size They pointed out that if the Curry company should fail to carry out any of five stages of construction planned in the next twenty-one years the city council could rezone the undeveloped part of the fifty-five acres turning it back to residence use are not going to invest their money in buildings if they are not reasonably sure of William Cozad chairman of the commission said Charles Curry said the plan was the result of studies of several years and that considerable aid had been obtained from members of the commission technical staff Kansas
