attorney general who asked that they be adopted in every county and every city and rigidly enforced They are: No person shall be permitted to consume or drink any cereal malt beverage between the hours of midnight and 6 a or on Sunday or any election day in or about a place of business licensed to sell cereal malt bever ages 2 No person while in a motor vehicle at or about a place of business licensed to sell cereal malt beverages shall be served any cereal malt beverage for consumption therein or thereon nor shall any person while in or upon a motor vehicle at or about a place of business licensed to sell cereal malt beverages drink or consume any cereal malt beverages The law is definite in respect to both these points QUESTIONS AND ANSWERS Outstanding questions and answers: Can a city or county refuse to issue beer licenses? Not if the applicant is properly qualified Can anyone prevent the issuance of a license? The township boards have the absolute veto power on a license sought for a place outside the limits of an Incorporated city Can a city by ordinance prohibit the sale of 32 beer within its limits? Only through the regulations it may establish The city or county may say that no beer may be sold within 500 feet of any school or any church and so long as these regula-1 tions are reasonable they are valid This would act to allow small towns to absolutely bar the sale of beer within their limits Can a city or county adopt such closing rules that it would be impossible for anyone to sell beer in an entire county? Yes by saying that beer can only be sold during certain hours it might make conditions such that no one would want to pay a license fee to sell beer Suppose a cafe also sells beer does that closing hour also close the cafe cfter midnight? No only the beer dispensing section must be closed down What about picnics or fairs? Each seller must have a license Suppose a man regularly makes a fair or picnic every week during the lair season? He can only have a license in the county where he lives Unless he forms a corporation he cannot obtain a license in another county Can a township board write a letter to the county saying "We do not want any beer sold in our township" and make that blanket order stick? No the protest allowed by the law must be made separately for each application Can there be dancing in a beer place? Not if any city or county adopts a regulation prohibiting it Can a beer place put on a floor show? Not if there are regulations against it What does a retail license cost? Whatever the city or county governing bodies may fix by ordinance between the minimum of $25 and the maximum of $100 a year Can a wholesaler also have a retail liquor license? No Can a wholesaler sell direct to consumers? He can only sell to those who have retail licenses Can a retailer buy from a wholesaler or brewer outside the state? No all wholesalers must have Kan-SBA licenses and be residents and comply with the law Who gets the license fees? The cities get the fees for places within the city limits the counties for places outside incorporated cities and the state for dining cars and wholesale houses Who pays a tax of 5 cents a gallon? The wholesaler or distributor If a man has been convicted of operating a slot machine can he be refused a license? That is a crime involving moral turpitude and he may be refused a license on that ground Can organizations give picnics and give away beer without taking out a Probably but that will have to be checked Can a retailer buy beer on consignment? No Every sale is a completed sale II officials prosecute someone for selling beer of higher power than 32 what should the court instruct? That any cereal malt beverage of more than 32 per cent by weight is an intoxicating beverage Can a wholesaler living in an ad-Joining state get a Kansas license? Not unless he has a manager who has lived in Kansas at least six months fulfills all 'other qualifica tions and has an established place of I business 1 What happens I the retailer sells beer?
