THE MIAMI HERALD MiamiHeraldcom METRO STATE FRIDAY DECEMBER 8 2006 SB TALLAHASSEE Advocates ask for 3 women's freedom don or someone's civil rights Neither Crist nor Gallagher would say Thursday how they PATRIA PERRY who initially claimed two men killed her husband in their Centra Florida home But of the three cases Telemachos' is the most complicated She was 19 at the time she was arrested in 1990 and was depicted as the mastermind of the killing of her father the owner of a Hollywood tobacco shop A jury recommended the electric chair but a Broward judge spared her The judge noted Telemachos' difficult childhood when she needed liver and kidney-transplants to remain alive Now 35 Telemachos is battling breast cancer On Thursday Telemachos' mother Mary Daniels testified on her daughter's behalf saying she felt ashamed she was unable to protect her "We are hoping and praying you will help us" Daniels told the board 8 Advocates for victims of domestic violence asked the state clemency board to release three women from their life terms saying they had all been abused by the men they killed BY GARY FINEOUT gfineout a MiamiHeraldcom TALLAHASSEE When she stood trial for the murder of her father Katherine Tele-machos was depicted by prosecutors as a greedy teenager eager for dad's money who convinced her boyfriend to pull the trigger while George Telemachos slept But 16 years after the Cooper City woman went to prison advocates for domestic-violence victims say there was another story that went untold at her trial: That she was a "sex slave" repeatedly raped by her father who threatened to kill her mother if his daughter did not submit to his wishes On Thursday the Florida Coalition Against Domestic Violence asked Gov Jeb Bush and members of the Cabinet to free Telemachos and two other women Sherry Perry and Sandra Patria from prison where they are all serving life sentences for murder Advocates contend each was brutally abused by the men they eventually killed DECISION IN DAYS Bush who is leaving office on Jan 2 declined to take any action on the three killers saying he would take each one "under advisement" which he explained as his need to ask more questions before he makes a final decision Bush who refused to answer questions about Telemachos after the meeting of the state clemency board said he would daughter a concubine he made her a sex slave" said McMahon "He raped her in every possible fashion" 'COLD-BLOODED' That account was disputed by Broward Assistant State Attorney Jeff Marcus who said that Telemachos once discussed with her boyfriend whether to claim that her father had abused her as part of her murder defense "Katherine Telemachos is not a victim she's a coldblooded greedy killer" said Marcus who added that Telemachos' motive was money since she had forged checks in her father's name and was about to have her crime discovered Similar discrepancies were echoed about Patria a 50-year-old woman from Manatee County who has spent nearly 23 years in prison and Perry TELEMACHOS would VOte ''Those are extremely serious cases" said Crist "It's important to balance what happened take it in its full context what the crime was that was committed versus the possible treatment received before the crime occurred" Bush and Crist heard conflicting accounts about what actually happened to each of the three women Elizabeth McMahon a psychiatrist told Bush that Telemachos endured years of suffering at the hands of her father "This man made his own decide within "a few days" The requests to free the women came during Bush's last meeting of the board which consists of Attorney General Charlie Crist Chief Financial Officer Tom Gallagher and Agriculture Commissioner Charles Bronson It marks just the second time that advocates for domestic-violence victims have brought a case in front of Bush Under Florida law it takes a yes vote from the governor and two other Cabinet members to grant clemency a par- DEATH ROW fingerprint on a matchbook left at the scene The case grew cold for four years and police focused attention elsewhere as the cocaine wars raged in Miami making it such a violent city at one point that machine guns were suspected to account for a quarter of all murders A break in the Velvet Swing case came when Gajus was jailed in 1984 for an unrelated killing He said Diaz was on the same floor as he and discussed by hand gestures and in broken English the killing of Joseph Nagy at the Velvet Swing Gajus now says he improperly inferred that Diaz was the shooter because he was angry Diaz excluded him from a jail escape plan Diaz had been serving a life term in his native Puerto Rico alter stabbing to death a drug rehabilitation director in prison where Diaz was incarcerated for bank robbery He then escaped wound up in a Connecticut prison where he skipped out and then came to Miami An accomplice Angel Toro pleaded guilty to the Velvet Swing killing "There are cases where the murder itself cries out for the ultimate punishment Then there are other murders where the person himself like Angel Diaz cries out for the death penalty" Diaz's original prosecutor John Kastrenakes told The Miami Herald Thursday Kastrenakes said Diaz nicknamed Papa de la muerte "Daddy of Death" in his Machete Men gang had impeded the case from the start He fired his lawyer at one point and represented himself in court and he threatened witnesses Court security was unusually strict with guards searching witnesses and jurors before entering court which was equipped with bullet-proof glass to protect the judge A gang member sought to avert his execution next week for a 1979 murder at a Miami topless lounge BY MARC CAPUT0 mcaputotfMiamiHeraldcom TALLAHASSEE Angel Diaz a murderous prison escapee and suspected member of the "Machete Men" Puerto Rican terror gang made one of his last appeals Thursday to the Florida Supreme Court claiming he was sentenced wrongly to die for his role in the 1979 murder of the manager of a Miami topless lounge At the heart of his appeal: "Jail house snitch" Ralph Gajus signed an affidavit recanting some of his trial testimony identifying Diaz as the shooter in the murder-robbery at the Velvet Swing lounge on Southwest Eighth Street But through their questions the justices seemed to agree with prosecutors and a lower court judge that Gajus' recantation wasn't really new or outcome-changing "The alleged recantation is nothing more than semantics" Justice Charlie Wells said reading from a trial-court ruling "And it certainly appears to me from my reading of it that it's correct" Diaz's lawyer Suzanne Meyers Keffer said Gajus' affidavit was important because it contradicted statements used to justify sentencing Diaz now 58 Diaz is scheduled to be executed Dec 13 by lethal injection which he says is an unconstitutionally cruel punishment Amnesty International and some politicians and activists in Puerto Rico have called for a commuted sentence as well Neither Diaz nor two other suspects was clearly identified as the shooter A topless dancer who ducked behind the bar and customers forcibly locked in the bathroom didn't get Africa on March 29 faces a UN-backed war crimes trial for alleged atrocities during Sierra Leone's civil war The father also has been linked to killings torture and other violence in Liberia responsibility for his actions Graham said Taylor's "oblique reference" to the new torture case was not of concern to him only his passport conviction Under federal sentencing guidelines Taylor faced between six and 12 months in prison Assistant US Attorney Karen Rochlin urged the judge to go longer than 12 months citing Taylor's failure to appear for trial on armed robbery and other charges in the Orlando area more than a decade ago His lawyer Miguel Cari-dad said that all Taylor did was lie about who his father was on his passport application a violation that deserved no more than two months in prison He added that the only reason the US government charged him in the first place was to "get its ducks in a row" to indict him on the torture charges The judge settled on 11 months in prison Taylor has The younger Taylor 29 a US citizen who was born in Boston and lived part of his youth in the Orlando area pleaded guilty to the passport charge in September On Thursday the shackled murders kidnappings and other violence blamed on his father's administration in Liberia The pair were in power from 1997 to 2003 an era scarred by civil war and ethnic conflict He also condemned
