The speedway filed the suit in September, demanding that the local governments pay them back for $4 million worth of road work and other improvements around the Concord track and nearby zMax Dragway. The city and county filed motions to dismiss shortly after. The court fight stemmed from an agreement in late 2007, when the local governments promised an $80 million in- centives package to keep the speedway in Concord.

The two sides agreed that speedway owner Bruton Smith would build the $60 million drag strip and complete $200 million in speedway upgrades in exchange for road and other im- provements estimated at $80 million. The parties later clashed over the terms, including the timetable for those incentives.
