preview of Mr Freeze Coolest Coaster on the Planet Sky high and really cool BY DAN REED Star-Telegram Staff Writer FORT WORTH In January when the 10 percent federal excise tax on airline tickets expired most of the nation's airlines passed the savings on to consumers But the same won't happen in 12 days when the tax reinstated by Congress in August expires once again This time the nation's airlines apparently plan to pocket the 10 percent windfall Most airlines have quietly raised the price of their standard leisure fares the 21-day advance-purchase fares by exactly 10 percent said Tom Parsons editor and publisher of Best Fares Discount Travel Magazine in Arlington So when the 10 percent federal tax expires Dec 31 the actual price of the tickets will be unchanged "The only difference will be that instead of 10 percent of the amount going to the federal government the airlines will keep 100 percent of that money for themselves" Parsons said The 21-day advance-purchase fare for travel between DallasFort Worth Airport and New York provides a good example Parsons said Last week that benchmark fare was $663 round trip including a base fare of $60273 and $6027 (More on quick to ask the courts to fix mistakes of their own making The news this week furnishes us with two examples one that has almost run its course and one that's just beginning In one banks asked a bankruptcy law review panel Tuesday to crack down on a record wave of personal filings that they precipitated by mailing credit card offers to everyone with a pulse and an address Meanwhile the Supreme Court declined to wade into a nasty spate of corporate litigiousness left over from the Texas real estate bust The high court let stand an appeals decision holding that (yes indeed) private mortgage insurance companies must abide by the language in their own policies The case of Verex Assurance vs Palma the mismatch of a 'General Electric subsidiary and a Texas homeowner perhaps suggests what the credit card industry wants When corporations turn to the courts they can field armies of attorneys Verex stars in the last chapter of a saga dating to the early 1980s and spawning thousands of lawsuits against Texas homeowners Ultimately the attorney general and Texas Department of Insurance intervened to force the private mortgage insurance industry out of the litigation business Private mortgage insurance 1 companies promise to make good on mortgages if homeowners default Borrowers who put down less than 20 percent are usually required to buy insurance Private mortgage insurance was a boom business in the early 1980s when inflation promised to price homes out of reach By 1987 with the state awash In foreclosures and home prices falling private mortgage insurance was a disaster zone Verex and other private mortgage insurance companies began suing homeowners to recover their losses on foreclosure sales despite a clause in their policies expressly prohibiting such lawsuits Their argument: The policy was a contract between the insurer and the lender Because homeowners weren't a party to it exccpt to pay for it they had no right to argue in court that insurers were violating its terms That the state courts bought this argument tells you all you need to know about "bidnessfirst" justice in Texas The 5th US Circuit Court of Appeals saw things differently
