Captain Nellson, master of the tug Pioneer, which arrived hero last night, Is today mourning the loss of the barge Haydn Brown, which he was towing Into port, and which he believes has been lost in the gale which struck both ships un they were passing the cape. Tile captain declares that be had to cut th. barge adrift In order to save his own vessel. Both boats were returning from Akutan harbor where they had landed supplies for the Alaska Whaling Company. On the morning of the ltith a heavy gale rose, nnd for several houra the vessels were tossed about in mountainous aeas.

To save the lug the captain ordered a meniher of the crew to cut the hawser. When last seen the Haydn Brown was plunging on her beam ends and when the storm subsided tho vessel was nowhere to be seen. Kight men f.re believed to have perished with the barge. On Tuesday, Sept. 12, be went to Vancouver to see the landlord, heard the newsboys in the street shouting about the murder, bought a paper und took it home and read the account to his wife. A lev nights after he dreamt about the murder, and subsequently on his trip to Nanaimo in search of work, while drinking in a bar. ho saw a man whose appearance co rri ponded with that of the man he saw in his dream.

The matter of the Cot'Vva' street hooting was mentioned, prisoner saying ho would like to see the man caught, and this man, who had half a glass of beer raised to his lips, placed It down, turned a frightened look at him und left the place. He knew absolutely nothing about a.ny bother with Hindoos on the train north of Nanaimo, as he was never half a mile north of that place in his life. He had spent two months in Nelson Jail for an assault at Movie, but be was not guilty of the Cordova street murder and knew nothing about it.

U. T. Lucas, who is back from Ottawa, where he attended the hearing of that case. Briefly speaking. It was just a case of misrepresentation In the case of the previous order of the board and politics had nothing to iio with it, according to the emphatic statements of Mr.

Lucas. Representing the residents of Uld Hazelton Townsite. the Old Hazelton Board of and the property owners of South Hazelton, Mr. Lucas attended the heating of the case before the executive council and succeeded In securing an order lor the reversal of the railway commissioners' order a legal victory that has only b.en accomplished once before since the board ot railway commissioners was created. That the railway commissioners acted In perfect good faith in the matter of making their order prohibiting the Grand Trunk Pacific plaeing their station anywhere but on the "Kelly town site'' goes without saying.

But the board gave the order without hearing the other side of the case, according to Mr. Lucas. The older for the rehearing of the case ius made on the representing of certain false statements made before the commission at the original hearing, the Incorrectness of the statements being admitted by the person responsible for them, and because at the ir lglnal hearing there were no Interests represented save thoe of the Grand Trunk Pacific and tho New Hazelton Townsite. while South Hazelton and Old Hazelton and other Interests vitally affected by the ruling of the coTrimis sion were without voice in the proceedings. One point Mr.

Lucas wished to make clear in his statement tn The World today, was that the application for the re openlng of the case as far as his clients were concerned, was not for the purpose of opposing the erection of a station on the "Kelly town site" of New Hazelton, but simply for the abrogation of the order which forbade the opening of the station at South Hazelton. Mr. Lucas went on to point out that at the original hearing before the Hallway Commission only two of the interested parties were represented. These were Mr. Kcllv and tho Grand Trunk.
