Chappell who helped put together an ordinance that would regulate bail bonding in city jail defended the proposal Monday from attacks by the city attorney and an organization of bail bondsmen City Council after hearing arguments pro and con on the proposal turned the matter over to the council's municipal course committee and the city manager's office for a three-week study CHAPPELL a member of the city's human relations commission which with the Fort Worth-Tarrant County turn aside complaints from City Atty Johndroe Jr that the ordinance was "void and invalid and unconstitutional on its face" Chappell later showed a reporter a letter from Riley Fletcher general counsel of the Texas Municipal League which said in part that "it is possible" for a home rule city such as Fort Worth to pass an ordinance regulating bail bond fees providing the state legislature could confer such a power on cities Johndroe during a pre-council session claimed that the state has pre-empted the field by regulating bail bondsmen and that it is left up to judges to determine who could make a prisoners's bond The city attorney said the proposed ordinance "would restrict who could make bond and defeat the purpose of the whole system" HE MAINTAINED that if the ordinance which provides for a three-man commission to license bondsmen and regulate maximum fees is passed it would prevent a private citizen from making bond for a friend Johndroe also said the ordinance attempts to regulate bonding practices at the state and federal court level Chappell told council members that "Mr Johndroe is not aware of what we're doing" The proposed ordinance would regulate only bondsmen who are in the business to make money not the next-door neighbor who was trying to help out a friend Chappell said Ile added that other provisions of the ordinance which would prohibit the solicitation of bail bond business within 300 feet of a public building setting maximum fees and making it unlawful for bondsmen to give "benefits" to police department or municipal court officials do not contradict state law Chappell also pointed out that the ordinance would regulate bonding procedures at the city level only although a provision provides that a bondsman may be put on a delinquent list if he fails to make good on a bond written at any other level Chief Municipal Court Judge Joe Drago III who commented that the proposal needed more study said that the main problem with the present bail bond system is that some bondsmen are overcharging clients and then failing to take care of their congressman's employes to kick back part of their paychecks and then coved it up with lies to investigators The Dallas Republican was scheduled to take the stand late in the day to testify against his former top Washington aide George A Haag 33 who is accused of taking MOO in kickbacks but his appearance was delayed by other witnesses Haag says he arranged the kickbacks but now Collins is trying to make him take the rap alone Defense lawyer Leslie Seherr told the jury in US District Court that Collins used the "unusual method" of kickbacks to pay bonuses to four employes including Haag for helping the congressman win re-election in 968 HE SAID IIAAG had agreed at one time to carry the blame for the kickbacks and not implicate the congressman "because he respected the congressman like a father" and (lid not realize that the kickbacks were illegal he co ngressman implored George not to involve him" Scherr said "lie said 'I would be disgraced in front of my family and my friends I cannot let them know I was involved in what happened' Scherr said Haag never got the full $10000 bonus but used part of the kickbacks he did get for office projects and part of it for his own use such as making a $1365 down payment on a car with one of the kickback checks Summarizing his charges Scherr told the jury "The evidence will show that the only he of th( money that changed hands was the when she told him Haag was not 'there and she was ready to return to Washington the congressman agreed to take the money himself Miss Lynne O'Shea testified she was paid the promised $1000 bonus for
