"Possibly not" he said "but I'm a prudent optimist" McGovern Humphrey and Muskie all appeared on the NBC program Meet the Press At issue in the California case is whether McGovern should have the entire 271- vote delegation on the basis of his victory in a winner-takeall presidential primary or whether the delegation should be apportioned among all the election entries on the basis of their shares in the popular vote In that case McGovern would get no more than 120 of the votes PALO PINTO Three men escaped from the Palo Pinto County jail here Sunday after they jumped a jailer forced him There are more than 60 ski lifts in New Hampshire that a majority of delegates eligible to vote will be sufficient to determine the California case benefited McGovern Humphrey contended that a majority of all delegates 1509 votes should be required to decide the California challenge But he said he would abide by whatever the convention decides Party Chairman O'Brien appearing on ABC's Issues and Answers said he had carefully avoided gauging the effect of parliamentary rulings on the basis of the effect on the presidential candidates "I've been very careful to avoid making head-counts of delegates" be said "and I made the decision without any regard to its effect on the nomination" platform and the rules under which he captured the California delegation Humphrey who had challenged McGovern and all other candidates to pledge loyalty to the ticket interpreted that as a commitment to support the nominee "I'm glad to see that the senator has changed his mind and is going to support the nominee of the party" Humphrey said Actually McGovern did not appear to have altered his position of offering support with a big "if" behind it McGovern picked up the endorsement of Rep Ronald Dellums of California a Negro who had supported Rep Shirley Chisholm's presidential candidacy Dellums appearing with McGovern said he could not "sit quietly while diabolical and cynical efforts are being made" to stop the front-runner With the opening convention gavel less than a day away this was The Associated Press count of delegate strength for the presidential nomination McGovm 32265 this one over 59 Illinois delegates led by Chicago Mayor Richard Daley but ousted by the Credentials Committee on grounds they were selected in violation of reform rules McGovern said he was hopeful "even at this late stage" that a compromise could be worked out on Illinois where an angry Daley could spell defeat for any Democratic nominee in November Daley orces in Miami Beach however indicated O'Brien the party and con: vention chairman estimated it would take about 20 hours to handle them all And the Democrats have said they will meet without recess until all credentials disputes are settled O'Brien announced he will rule that a majority of the delegates eligible to vote on the question will be enough to decide it The question had been whether convention rules required an absolute majority of all delegates 1509 votes or a majority of those eligible on an issue In the case of 'California the 151 contested delegates cannot vote on their own seating O'Brien's ruling is sure to be challenged forcing a convention vote about who can vote Translated the parliamentary ruling means McGovern can regain the California sweep if he can assemble 1433 delegates His strategists claim more than enough to gain that end Humphrey's managers disputed that "Under the most adverse circumstances we expect to win" said Stanley Bregman a Washington lawyer and Humphrey aide McGovern said he couldn't forecast the count on the California issue "I can only tell you at this point my own personal prediction which is that we will win the California case and go on to win the nomination" he said 7 McGovern said if any other nominee is to have his sup: port "they must support the rules under which we sought the nomination" meaning the California sweep he thought he had won in the pri: mary "We
