Immigration drops amnesty ban for DWI Federal immigration officials have dropped a provision that withheld amnesty from undocumented aliens with a drunken driving conviction in Texas in the wake of a four-month lobbying effort against the policy The US Immigration and Naturalization Service before yesterday's action had subjected immigrants to exclusion under the policy regarding driving while intoxicated convictions Texas law categorizes DWI as a misdemeanor on first offense but a conviction carries a jail sentence of up to two years meaning that it is considered a felony under immigration agency amnesty policies A felony conviction bars applicants from amnesty Immigration agency Commissioner Alan Nelson agreed yesterday to change regulations so that any offense deemed a misdemeanor under state law will be a misdemeanor for amnesty purposes if the alien received a jail sentence of less than one year of an Arlington man out of Johnson County even though defense attorneys contend murder defendants can't get a fair trial in Cleburne Judge John MacLean denied a defense motion for a change of venue in the trial of Ronald Trimboli but said he might change his mind if lawyers have difficulty picking a jury in 249th State District Court next week A state district judge in Fort Worth transferred the trial to Johnson County last week ruling that Tarrant County has been saturated with publicity about Trimboli But defense attorneys argued that Cleburne residents rely on the same media as Tarrant County residents and have been exposed to the same amount of news coverage Trimboli is charged with three counts of murder in the deaths of 17- year-old John Paul Bradley I 2-yearold Renee Lemieux and I4-year-old Danielle Lemieux All three were found stabbed to death in the Lemieux home in southwest Arlington MacLean also imposed a temporary gag order on attorneys ruling that lawyers cannot talk with reporters about the facts of the case or their opinions on whether Trimboli can cases to the attorneys Joe Plumlee who said financial troubles forced him to halt his Plumlee Emergency Medical Service in Parker County in April 1983 said attorney Michael Paddock promised to pay him 10 percent to 50 percent of the law firm's fees from those referred cases Paddock also agreed to pay Plumlee money" for each case according to the lawsuit filed in 17th District Court in Fort Worth suit over retarded boy A federal judge has dismissed a $35 million suit filed against doctors at Carswell Air Force Base hospital by parents of a mentally retarded boy Dirk and Cynthia Bradley filed the suit after their son Brad was born prematurely in May 1978 The suit said the child suffered brain damage and multiple handicaps as a result of brain hemorrhaging at birth His delivery by Caesarean section was a non-emergency court records show The child was transferred to John Peter Smith Hospital shortly after his birth because the Carswell hospital did not have proper facilities to care for a premature child The child's parents claimed in the lawsuit that Carswell doctors were negligent in permitting the delivery of a premature child at the base hospital when they were not prepared to deal Kemp Jr 21 of 1200 Seminary Drive in Fort Worth was iindicted on charges of capital murder and attempted capital murder He is accused of fatally stabbing bus 'passenger Johnnie Gray 34 of Fort Worth The attempted capital murder 'charge stems from the stabbing and robbery of bus driver David Jeanfreau 22 who was forced at knifepoint to drive the bus to Trinity Park The bus hijacking occurred five days the suspect had been paroled from prison Kemp has been held in lieu of I million bond since his May 31 arrest If convicted on the capital murder charge he could receive the death penalty or life
