Peacock City Clerk ORDINANCE NUMBER 183 AN ORDINANCE ESTABLISHING THE HOURS AND PLACES FOREHOLDING THE REGULAR CITY ELECTION FOR CITY COUNCILMEN TO BE HELD APRIL 6, 1963, AND PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF LA MARQUE, TEXAS, PROPOSED AMENDMENTS TO THE CHARTER. WHEREAS, Section 4.01 of the City Charter directs that the regular election for the choice of members of the City Council shall be held on the first Saturday in April of odd numbered years, and WHEREAS, there has been presented to the City Council a Petition bearing the signatures of qualified voters of the City of La Marque, Texas, signed by not less than ten percent. of the qualified voters of said City, as certified to by the City Clerk, petitioning for certain amendments and changes in the City Charter, and WHEREAS, pursuant to Article 1170 of the Revised Civil Statutes of Texas, as amended, the City Council is directed to provide by Ordinance for the submission of such amendments at the next regular municipal election if one is to be held, not less than thirty (30)days, nor more than ninety (90) days after the passage of said Ordinance, and WHEREAS, the regular election for members of the Council as set out in the said Section 4.01 is to be held April 6, 1963, which is not less than thirty (30) nor more than ninety (90) days after the passage of the Ordinance, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAMARQUE, TEXAS: Section 1: It is hereby ordered that the regular election for the election of five (5) members to the City Council shall be held April 6, 1963, and there shall be submitted at such regular election to the qualified voters of the City of La Marque, Texas, propositions to amend the Charter of the City of La Marque. Section 2: The Propositions to be submitted at such regular general election are as follows: PROPOSITION NO. 1 "Should the form of Government of the City of La Marque be changed from what is known as the "Council- Manager" government to what is known as the Strong Mayor- Council" form of Government by amending the City Charter to make the Mayor a directly elected officer; making the Mayor the Chief Executive and Administrative officer of the City, and giving to him the powers now granted and dutie Household Goods 22 36" GAS RANGE.

Amend Section 1.02 of Article 1 to read as follows: "Section 1.02 Form of Fov- ernment The power of the Municipal Government of the City of La Marque, Texas, shall be vested in a Mayor and four Councilmen, elected as hereinafter provided. Pursuant to this Charter, and subject only to the limitations imposed by the Constitution and Statutes of the State of Texas and by this Charter, the City Council shall enact all necessary legislation pertinent to Municipal affairs, shall adopt budgets and determine municipal policy, and shall exercise all necessary powers granted to said Council by this Charter and the laws of the State of Texas.

The Mayor shall be the Chief Executive and Administrative Officer of the City and shall be responsible for the execution of all Municipal Laws and the supervision of the administration of the City Government in accordance with law. 2. Amend the Title of Article 11 to read as follows: "ARTICLE 11, THE MAYOR AND THE COUNCIL" 3. Amend Article 11, Section 2.01 to read: "Section 2.01 Number of Councilmen, Terms and selection of Mayor and Councilmen. The City Council shall have five members who shall be the Mayor and four councilmen elected from the City at large in the manner provided in Article hereof for terms of two years, which terms shall begin on the second Tuesday, next following the election." 4.

Amend Article 11, Section 2.02 to delete therefrom the words "city manager" appearing in the last sentence of said Section. 5. Amend Article 11, Section 2.07 to read: "Section 2.07 Mayor Pro Tern. The City Council, at its first meeting, shall elect from the qualified Councilmen a Mayor Pro Tern to hold office at the pleasure of the Council. The Mayor Pro Tern shall act as Mayor in the absence of the Mayor, and while so acting shall have all of the power and authority herein delegated to the Mayor together with all the duties and incidents of that office.

If the Mayor's office becomes vacant, the Mayor Pro Tern shall become Mayor for the unex- pired term, and the vacancy of his office as Councilman shall be filled as provided in Section 2.03 hereof. 6. Amend Article 11, Section 2.10 by deleting therefrom Subparagraph (a) reading' 'appoint and remove the City by redesignating the remaining paragraphs in alphabetical order. 7. Amend Article 11, by repealing Sections 2.11, 2.12 and 2.13 thereof.

8. Amend Article III, by changing the Title thereof to read: "Article III, The by repealing Section 3.01 and substituting therefor the following Sections: "Section 3.01 The Mayor's Authority. The Mayor shall preside at meetings of the City Council and shall be recog- as head of the City Go- vernment for all ceremonial purposes, and by theGovernor for purposes of military law. He shall be entitled to vote upon all matters considered by the City Council but shall have no veto power. The Mayor shall be the Chief Executive and Administrative Officer of the City and shall have all the powers granted, and duties imposed by this Charter, Council action not inconsistent with this Charter, and by the laws of the State of Texas.

He shall have power to administer oaths, together with all the powers, authority and duties hereto fore established for the "City Manager" by this Charter. 9. Amend Article 11, Section 2.09 and 2.04, Article III, Sections 3.03, 3.04, 3.05, and 3.06, Article VI, Sections 6.02 6.03, 6.09, 6.10, 6.13, 6.14, 6 15, 6.16, 6.23 and 6.25, Article VIII, Sections, 8.01, 8.04, 8.05, 8.06, 8.07 and 8.14, Article Section 10.02, Article XI, Sections 11.03, 11.04, 11.06, Article XII, Sections 12.08 and 12.11, Article XIII, Section? 13.01 and 13.02, and all other Sections of said Charter where the words "City manager" are used to delete the words "city manager" and to substitute there- for the words "the Mayor. PROPOSITION NO. 11.

"Should the power of the City Council to appoint members of Boards and Commissions as set our in Section 2.10 (f) of the Charter be amended to require the prior recommendation of the Mayor for such appointments in the event the "Strong Mayor-Council" form of government is adopted, and to this end, 1. Amend Article II, Section 2.10 subparagraph (f) to read: "appoint the members of Boards and Com missions upon recommendation made by the Mayor." PROPOSITION NO. III. "Should the Charter be amended to provide that the Salaries of the Mayor and Councilmen shall be fixed by the City Council in an amount not to exceed $200.00 dollars per month for the Mayor and $50.00 per month for each Councilman in the event the Strong Mayor-Council form of government is adopted, and to this end, 1. Amend Article Section 2.06 to read: "Section 2.06 Salary.

The salary of each Councilman, other than the Mayor, shall be fixed by Resolution of the City Council in an amount not to exceed fifty ($50.00) Dollars per month." 2. Amend Article III, Section 3.02 by repealing present Section 3.02 and substituting the following: "Section 3.02 Salary of the Mayor. The salary of the Mayor shall be fixed by the City Council in an amount not to exceed $200.00 per month at the first meeting next succeeding the adoption of this amendment; the salary established for the Mayor shall not be increased or decreased to be effective during the term of office for which he is elected. PROPOSITION NO. IV.

"Should the Charter be amended to require that any zoning Ordinance submitted by the Planning Commission must be approved by a majority vote of the City Council, and to this end, 1. Amend Article Section 10.06 to read: "Any zoning Ordinance submitted by the Planning Commission must be approved by a majority of the City Council." Section 3: That said election shall be held at the following polling places within the City- of La Marque, Texas: Polling Places City Hall Building, LC Marque, Texas, for Precincts Nos. 44, 45 and 46. Highlands 1 entary. School for Precinct Nos.

46, 64 and 36. That the following named persons are hereby appointed officers to conduct said election in said polling places, repectively: POLLING PLACE City Hall Building, La Marque, Texas. Highlands Elementary PRESIDING JUDGE Mrs. J. E.

Section 5: All of Charter Amendments, or shall be voted on "YES" or "NO." Section 6: A copy of this Ordinance shall serve as a call for and proper notice of the election herein ordered and shall be published in the La Marque Times, a newspaper of general circulation published in the City of La Marque, on the same day of each two successive weeks; the date of the first publication to be not less than fourteen days prior to the date set for said election. In addition the Chief of Police is hereby directed and instructed to post a property executed copy of this Ordinance at the City Hall, La Marque, Texas, and at two other public places in the City. Such posting shall be made at least thirty (30) days before the date of said election. Section 7: The polls shall opened at 7:00 A.M., and close at 7:00 P.M., on April 6, 1963. Section 8: The effective date of this Ordinance shall be the date of its adoption on second and final passage.
