Mitchell, former president of the United Mine Workers of America and one of the most widely known labor leaders in the failed Stales, died at 5 o'clock this afternoon at the post graduate' hospital. Mr. Mitchell was only 49 years old. Altlio he underwent an operation ten days ago for the removal of gall stones, his condition had been reported as entirely satisfactory and his death was wholly unexpected by his friends. With Mr.

Mitchell when he died were his wife, his son and daughter. Governor Smith, who had called to inquire about Ijis condition, arrived only a few minutes after he had breathed his last. Since 1915, Mr. Mitchell had been chairman of the New York state industrial commission. He also served as president of the state food commission, chairman of the federal food hoard, president of the New York state council of farms and markets.

It was announced that plansfor the funeral had not been completed, hut that interment would be in Scranton, l'a. It was learned tonight that blood transfusion was resorted to in an effort to save the life of Mr. Mitchell.

When his condition became grave last Monday, attending physicians decided after a hurried consultation, that a generous supply of new blood might avert the approaching crisis, and his two sons, Robert and James, 22 and 24 years old, begged for the opportunity lo give their blood. Kobert, being the younger, was accepted, but the patient Jfailed to rally after the transfusion. Paris, Sept. 0r The Rumanian delegation to the peace conference announced today that it would not sign the Austrian peace treaty, the signing of which by Austria and various other powers is set to take place at 10 o'clock tomorrow morning. Before the ltumanian announcement was made, it had been indicated by members of the supreme council that Rumania was expected to take the course she has announced in refusing to sign the treaty, because of the council's flat refusal to grant her the privilege of making reservations in connection with Jhe rights of minorities in territories detached from the former Austrian empire, as provided for in the peace treaty.
