A dozen witnesses testified, their testimony filling 120 typewritten pages. Mrs. Mae Klompus, who formerly conducted a fur shop on North Second street, was granted a divorce from Samuel Klompus, Market street confectioner, for cruelty. R. Under the act of 1899, it was pointed out today, the election board was required to hand and file an affidavit for each voter whose name was not on the official register and who was certified on the election board's poll book as having received a November ballot. This act of '99 specifically requires the election board to return the affidavits to the prothonotary, along with the election return. As a further guide to the election board, the official envelope, provided for returning the affidavit slips, bears the printed statement that the affidavits are to be certified Under seal to the prothonotary. In connection with this ballot box opening, Prothonotary Bailey said in substance that the data he gave to Judge Fox and to the specal computing board, minus the affidavits, was all the election board turned in at his office. The ballot box was searched carefully for the affidavits but none was found.

Election law authorities say the acts of 1893 and 1899 were aimed to prevent unqualified electors from voting and to prevent "repeater voting." The affidavit system was to be a safeguard as well as a means of giving voting rights to otherwise qualified electors whose names, for one reason or another, had not been put on the registry list. Among those certified by the election board as having voted but whose names, it is declared, were not on the original registry list were: Mattie Barker, Line Brown, Mary Holmes, Charlemae Jones, Emma Mays, Bertha Mays, Bessie Norris, Clyde Minich, Guy Rouch, John Singleton, George Sweet, and Elizabeth Winci. No affidavits were found bearing their names.
