rtifHfTitrlr ttiraTff 43 The Miami Herald Wednesday Dec 23 1981 Teamsters members indicted for film kickbacks By ALICE KLEMENT Herald Staff Writer A federal grand jury Tuesday indicted two members of Teamsters Union Local 390 for allegedly forcing out-of-town film production companies to put dead men on their payrolls and then pay kickbacks Vincent Marciaro a 54-year-old West Hollywood man Just reelected as the secretary-treasurer was indicted on two counts of conspiracy and extortion Also indicted was longtime union member Harry Tuttle 54 of Pembroke Pines The 2100 members of the union local an International Brotherhood of Teamsters affiliate drive trucks along routes between Fort Pierce and Miami According to the indictment Marciaro and Tuttle extorted payments from four companies that produced films and commercials in Miami for six months during the late 1970s The three-count indictment describes a scheme starting in November 1976 when the two union members started persuading the small production companies to pad their payrolls and turn over salaries to them Each count carries a fine of up to $10000 and imprisonment for up to 20 years upon conviction According to the indictment Marciaro and Tuttle supplied the names of dead men or men who would not offer any services filed false W-4E forms on their behalf and then collected the salaries To keep the companies in line the union men then threaten the companies and their employes with force violence and fear of economic loss" according to the indictment Dead men first joined the ranks of Weth erly Production Inc which came to Miami to film Empire of the Ahts in late 1976 Marciaro and Tuttle reportedly collected more than $5000 from the subsidiary of American International Pictures of Beverly Hills Calif Familiar names subsequently appeared on payrolls for James Garrett and Partners and Equinox Production Co They filmed respectively Oil of Olay and Ranch House commercials in April 1977 Tuttle is charged with extorting $665 from the the New York-based Garrett company Many of same names resurfaced in mid-May 1977 when Freight Train Productions began filming ads for a nationwide furniture retailer Marciaro's arrest Tuesday came two weeks after his election by a 2-1 margin to another three-year term as the secretary-treasurer Headquartered at 2940 NW Seventh St the union local came under legal fire earlier this year in another case Five members filed a federal suit charging that the union failed to defend their rights adequately after Grand Union laid them off in 1978 Both the food-store chain and the union are named as defendants The case is set for trial in February before US District Judge Sidney Aronovitz Allegations of violence have marked recent union elections Former president Ernest Grass died in 1979 when the brakes of his rig failed during a Virginia haul shortly after he lost a reelection bid An FBI investigation reportedly failed to substantiate allegations of tampering In 1972 Lloyd Hicks was gunned down at the union hall shortly after he announced his candidacy That murder is still unsolved The union is now under contract with about 65 companies including businesses such as Food Fair Grand Union and the Hertz and Avis car rental agencies Gunmen waited at home to kill fisherman Ojus dump interests Dolph ins Police said the victim may have
