tate Sunday, Jan. 8, 1984 Santa Cruz Sentinel-A-9 'Twilight Zone' case could drive film industry from state 7 feel a precedent already has been set. I think the movie industry has been shaken by this accident because it appears that insufficient safety precautions were taken. He said Landis "fulfilled his responsibility" and should not be held accountable, adding he knew of no other instance in which a director had been tried for a filming accident. Braun expects the preliminary hearing to last four to six weeks.

During grand jury proceedings last summer, "Twilight Zone" workers testified the filmmakers knew they were violating state laws by using the two children Myca Dinh Le, 7, and Renee Chen, 6 in the early morning hours of July 23, 1982. Folsey and Allingham were charged only in the two childrens' deaths. Charged in all three of the deaths are Stewart, Wingo and Landis, who has directed such movies as "Animal House," "The Blues Brothers" and "An American Werewolf in London." If convicted, Landis, Wingo and Stewart face maximum six-year prison terms, while Folsey and Allingham face maximum five-year terms. William Vaughn, an attorney representing Warner declined to discuss the pending hearing, but confirmed the company had reached an out-of-court settlement in a wrongful death suit filed by the family of the 56-year-old Morrow. Terms were not diclosed, but industry sources reported the settlement was $875,000.

Wingo was flying the helicopter during early morning filming of a Vietnam war sequence in a riverbed near Valencia, 40 miles northwest of Los Angeles. A powerful special effects explosion disabled the craft and it fell on the three victims, killing them instantly. Landis' attorney, Harland Braun, said Thursday that if the case went to trial and Landis was convicted, no filmmaker ever would risk filming in California again. "It's very important because the defense basically is that in dealing with special effects and aircraft, the director is required by law to hire experts, and that he did hire experts and he used experts and still there was an accident," Braun said. mart" ADVERTISED MERCHANDISE POLICY LOS ANGELES (AP) A hearing starts Monday for five filmmakers charged with the deaths of three actors during production of "Twilight Zone," in what some lawyers call an unprecedented case that could drive the movie industry out of California.

The preliminary hearing before Superior Court Judge Brian Crahan is to determine if there is enough evidence for director John Landis and four others to stand trial on charges of involuntary manslaughter for the July 1982 deaths of actor Vic Morrow and two children. Attorney Jerome Berchin, who is suing the filmmakers and Warner Bros, studio for $200 million on behalf of one child's family, said the very prospect of a trial is unprecedented. "I feel a precedent already has been set," Berchin said. "I think the movie industry has been shaken by this accident because it appears that insufficient safety precautions were taken." "It's already had a very substantial effect in terms of insurance, in terms of who's covered under insurance and in terms of some directors' extreme nervousness about making some kinds of movies at all," said prominent entertainment attorney Tom Pollock. More than $82,000 in fines, currently on appeal, have been assessed by state health and labor agencies against the movie-makers and Warner which distributed "Twilight jZone" to theaters last summer.

Neither Warner Bros, nor co-producer Steven Spielberg were charged with criminal violations. "We didn't have sufficient evidence to show that, criminally, they (Warner Bros.) were responsible for this," Deputy District Attorney Gary Kesselman said Thursday. Last June, a county grand jury indicted Landis, associate producer George Folsey production manager Dan Allingham, special effects coordinator Paul Stewart and helicopter pilot Dorsey Wingo. The girl, Patti Pritchard, was found in good condition Friday on the shore of Vandenberg Air Force Base, 150 miles up the coast from Los Angeles. She fell off her grandparents' boat, the Putty Ann, sometime Thursday night.

Later Friday, base personnel found the body of her grandmother, Betty Pritchard, washed up on the shoreline not far from remnants of the boat, Coast Guard Petty Officer Tony Chilelli said. "We have totally saturated the area where the debris and body were found, and there's no trace of the grandfather," Chilelli said. He identified the man as Jim Pritchard but said he did not know the couple's ages. The grandparents were the girl's legal guardians, he said. All lived in Glendora, about 25 miles northeast of downtown Los Angeles.

The three were sailing from Santa Barbara to Morro Bay when the boat broke up. Chilelli said the cause of the wreck remained under investigation but noted that small craft advisories had been posted along their course Thursday night. Pattie Pritchard was placed with the Santa Barbara County Social Services Department, which was attempting to locate other relatives, Chilelli said. She and her dog were the only ones aboard the Putty Ann wearing life jackets when the boat ran into trouble. Chilelli said the dog's body washed ashore Friday along with the boat's transom bearing its name, doors and "other bits and pieces." Military patrols would be watching for any sign of Pritchard on their daily runs, he added.
