If this is true, the owner is in violation of the terms of the permit in my opinion," Schindler said. Commissioner Max Kreston made the motion for the commission to concur with Schindler's recommendation. It was approved unanimously. Kaufman is the third owner of the project since it was first proposed to the city nearly three years ago. The commission granted tentative approval to W.J.E. Corp.

in September 1976 to construct a 44-unit "senior citizen housing project." W.J.E. are the initials of San Bernardino builder Wilmer Engevik, a Redlands resident. The City Council granted tentative approval to the tract map on the project on March 1, 1977, with Engevik still the developer. On Nov. 15, 1977, the council granted final approval to the project after the ownership transferred to VACO Developers, Inc.

Kaufman's firm assumed the ownership after that date, Schindler said. Schindler contended that, although the age restriction on housing was not specifically addressed at each hearing on the project, "it was understood by all." By MIKE MURPHY Sun Staff Writer REDLANDS The Planning Commission here has urged the city attorney's office to investigate possible violations of a conditional use permit granted to the builder of a 44-unit housing complex here. The issue, Planning Director Bill Schindler said, is whether or not housing units are being sold to buyers under the age of 45, which he said would be in conflict with restrictions included in the permit. The developer, Melvin Kaufman, of Redlands Homes, of Laguna Hills, could not be reached for comment Wednesday. The tract is now nearing completion at the southeast corner of New York and State streets.

Schindler said the conditions, covenants and restrictions for the project were recorded July 14, 1978. In the document was wording that "this project is designed and intended for the use and residence of those persons who have attained age 45." Feb. 26, Kaufman filed an amendment to the document, Schindler said, that altered the wording, deleting the restriction on age. Schindler said the project was granted certain reductions in the property development standards of the R-2 zone "because the project would be voluntarily restricted to persons 45 years and older." Less than minimum standards for covered parking, lot area, lot width and lot depth were accepted by the commission and City Council based on that understanding, Schindler said. "A lot of people say it's like the jitterbug, but, for most students, disco is a totally new experience." Lee says disco dancing is her favorite. "They say it's here to stay, but if it doesn't, it's been great exercise." One older couple taking lessons described the dancing as "relaxing." The final exam for the course is a visit to an area to try out what they've learned.
