Justice Stephen Field had been dismissed by a Stockton Court Judge Sawyer accordingly dismissed the habeas corpus proceedings in tiie case of Justice Field and said: are glad that the prosecution of Mr Justice Field has been dismissed founded as it was upon the sole reck less and aa to him manifestly false affidavit of one whose relation to matters leading to the tragedy aud whose animosity towards the Courts and Judges who have found it their duty to decide agaiust her and especially towards Mr Justice Field is part of the judicial and notorious pubiio history of the oountry It was under circumstances aud upon a sole affidavit produced especially after the Corouer'e inquest So far as Mr Justice Field Is concerned it was a shameless proceeding and as estimated by the Governor of assaulted by one so violent as to be publicly reported not only then but on Dumerous previous occasions to have threatened his life are extremely gratified to find that through the action of the Chief Magistrate and Attorney-General a higher officer of law we shall spar' the necessity of further inquiring as to the extent of the remedy afforded the distinguished petitioner by the constitution and laws of the United States or of enforcing suob remedies as exist and that the stigma oast upon the State of California by this hasty and to oail it by no harsher term ill advised arrest will not be intensified by further prosecution since the State proceeding has been dismissed the petitioner be discharged and the writ of habeas corpus dismissed" THE CASE OF NEAQLB The ease of Deputy Marshal could nuke a trap door in a back room and cover the whole floor with oil cloth He said the tacks could be filed down on the trap door and none wpuld know of its existence He first talked of counterfeiting $1 pices and afterward said they could make $5 $10 and even $20 gold pieces Afterward Eddy came out and advised witness to leave the saloon business and go to his miue in the mountains where they oould engage in counterfeiting without fear of detection Witness on cross examination said that when Eddy requested him to get the sheet tin he considered it Witness heard some one say that Eddy was a and a detective AN UNWARY WITNESS George Johnson was recalled Hart asked it witness had made the statement he gave this morning without inducement from Chief Lee and witness said he had and clean as a tidy kitchen They have in use there what they call a mixing machine of their own invention in which the ingredients which go to make up the candy are stirred by paddles run by machinery it saves a great amount of manual labor In the engine room is a great steam boiler and near by is a Westinghouse engine of sixteen horse power This machinery runs the scores of belts winch go all over the establishment to set the various wheels in motion Among ths machines is one for grating cocoanuts popping corn and roasting peanuts Two men are employed to make the common stick candy of which they tuin out six hundred pounds every day All of the candy except the common kind is made by Bteatu The other has to be cooked in kettles which are heated np to 320 degrees Fahrenheit Over two miles morning when the vagrancy oase of Frank Eddy of the Law and Order League force of detect-vea waa called for hearing The attorney for Eddy Hiram Johnson had demanded a jury trial and a gpod part of the audience waa composed of citizens whose names appeared on tbe venire Clerk Larkin was progressing swimmingly in calling the names when Johnson who waa listening intently addressed the Court honor I thiuk we want a jury waive that and leave the case entirely to the The announcement rather astounded the officials but Hart attornoy for the prosecution had presence of mind to say that he was willing It was learned afterward that Johnson's objection to the jury was that the venire contained the names of a number of saloon keepers whose ttelinga may have been antagonistic to the detective legion The case was ordered to pro ceed THE FIRST WITNESS The first witness called was officer Henry Carroll When sworn the officer testified that he knew Eddy about a year that in alt that time he did not notice him engaged in any work while on night watch he saw him on the streets near Third anfi Third and and Second and streets from 9 o'clock at night to 3 o'clock in the morning Hart asked witness if he knew Eddy had any lawful business and witness was about toJ relate a conversation which occurred at Third and strets when Johnson objected on the ground that the question was not germane to the in the counterfeiting business with him Johnson objected on the grnuuJ that Eddy waa not being tried for counter feiting Hart insisted that tbe testimony was proper as showing his dissolute habit Johnson then endeavored to choke off the witness by raising the point that the conversation occurred outside of the time allotted by the law Judge Buckley ruled that the evidence was proper Witness continued that Eddy wanted to counterfeit standard dollars men tioned other people living in the city who would go in the business with them but did not say when he was ready to Start out He told
