resort-casino and the 2300-acre Double Diamond Ranch near Reno appeared to be dead Monday with the failure to meet a court-imposed down-payment deadline Federal bankruptcy Judge Lloyd King earlier this month gave Huntington Beach developer John Fleming Jr until Dec 21 to come up with the $105 million deposit to purchase the Reno properties from the bankrupt real estate empire of George I Benny Without the deposit by 5 pm Dec 21 bets are Judge King told Fleming A bankruptcy court clerk confirmed Monday no documents concerning deposit to the Southern California escrow account had been recorded with the court by Dec 24 Failure of the Fleming deal to remove the River Inn and Double Diamond Ranch development from the bankruptcy proceeding opens the way for Nevada National BanSL to press its efforts to foreclose on the Reno properties at the next court hearing Jan 3 The bank is attempt- ing to recover more than $14 million in two loans made to Benny for his lease rights to the River Inn The judge refused to allow the bank to move against the property prior to the January hearing The financial dispute centers on the on River Inn resort built after the turn of the century a 25-acre property known as the mogul strip on 1-80 and the Double Diamond 1 1 Ranch approved for development of 3000 homes in a south of i Reno All three properties are mired in more than $50 million in debtor claims with 50 attorneys represent- -ing the interests of everyone from banks seeking mortgage repayment to contractors and engineers" demanding payment for past work Benny is serving a objected to having bicy-c les near their bnck yards so about a mile of the trail was built on rock fill placed at the edge at the foot of the bluff The riding and hiking trail remains on top Besides cyclists the new bike trail attracts joggers and birdwatchers A recent ride produced sights of several birds including Oregon juncos black phoebes Wilson's warblers and western bluebirds Audubon Society members plan to use the trail Thursday for one of their annual holiday counts They hope to spot great blue herons which have a rookery on the south shore and golden or even bald eagles which sometimes winter in the foothills Robert Baxter the state Parks Department landscape architect who has worked on the Folsom area trail project seven years said spotted many deer and snakes in-( luding rattlers His advice to cyclists who want to avoid rattlesnakes is to stay on the trail ride in the high brush" he said Already the early rains are sprouting green grass and by spring area wildflowers such as the California poppy Indian paintbrush mon-keyflower and mustard should be blooming For cyclists arriving by car the new trail is best reached from the boat parking area at Negro Bar off Greenback Lane near downtown Folsom It also can be reached from a spur trail that starts near the junction of Main and Sunset avenues in Fair Oaks With the bike trail finished the stale is getting a four-acre site ready on the south side of Sunset near Main for a horse stable The Shadow Glen stable has received an eviction notice from its site on Hazel Avenue near Nimbus Dam to make way for a housing development Sacramento County supervisors have provided $50000 to the state to provide fencing and utility services at the new site Separately a fund drive has started to help stable owner Ralph Stone pay to move horses corrals and buildings to the new location The 69-year-old Stone who lives on pensions from 39 years in heavy construction and calls the horses a labor of love says he lacks money to finance the move himself He asks donors interested in keeping open the only stable on the American River and the only year-round public stable in Sacramento County to send checks to Shadow Glen Moving Fund PO Box 16295 Sacramento 95816 He says if he raise the money have to sell some of his 35 horses which are trained to carry young riders safely Meanwhile the state has opened a
