The Sacramento Bee Tuesday December 28 1982 B3 New Light Lumberjack Store Flail Controversy ransit Agency Fight Over rack Site Man Slain In Shootout Called Hero the south side of Arden Way through North Sacramento Directly in the way is an outlet of the Lumberjack home improvement chain at 936 Arden Way At first planners laying out the light-rail system planned to skirt the south side of the store But not as direct as going through the Lumberjack property where the tracks used to go Preferring the more direct route the Sacramento Transit Development Agency which is planning and building the light-rail system recently filed a quiet title suit in Superior Court against Lumberjack and the underlying property owners to claim the easement it believes it acquired from WP to use all the old route Attorneys for Lumberjack strongly protested the routing at a recent meeting of the agency board They complained that the route would separate the store from the parking area endangering patrons and possibly impairing sale of the Lumberjack chain Attorneys William Holliman and Richard Brown also suggested that WP several years ago discontinued for the routing through the property and that the planned use by commuter trains running up to 7 12 minutes apart would be much greater than an occasional WP freight of years past They also said they were surprised that the transit agency would the store By Doug Dempster Bee Staff Writer Local state and federal officials gathered Monday at the Woodlake Inn to mark an almost imperceptible step in the long road to build an 183-mile light-rail system in Sacramento They break ground with fake gold shovels or drive a gold spike That comes later Rather the officials convened to mark the first day contractors could purchase a complete set of plans for bidding on the first part of the $1248 million project That part consists of three bridges which will cross the light-rail tracks and the parallel Southern Pacific main line The bids will be opened by the California Department of Transportation in February and construction may start in March with completion scheduled for September 1984 a few months before the first trains are scheduled to roll Timing of event was designed to give officials such as departing Caltrans director Adriana Gianturco a last platform to extol the virtues of light rail After the ritual commenced at the Woodlake Inn the officials moved by bus to Arden Way near Evergreen Street where one of the overpasses is scheduled to be built Although carefully ignored in speeches a major controversy has broken out yards Five Anacin-3 capsules laced with cyanide were shipped to Cincinnati Monday for tests to determine if the product tampering was linked to the poisoning of a Northern California woman last month State investigators scoured Southern California store shelves for evidence of further tampering of Anacin-3 Maximum Strength capsules pulling all boxes without tamper-resistant seals or those from lot F229 to test for cyanide said Ralph Loun-sbury of the state Department of Health Services Since the Christmas Eve announcement that a bottle of cyanide-laced Anacin-3 from lot F229 was discovered in the San Pedro area chemists have run tests on about a dozen bottles from the same lot Lounsbury said No cyanide has been detected in any other bottles he said appears to be only the one Lounsbury said know not throughout the whole lot so it was not done at the factory It must have been done after it reached the retail outlet but impossible to and its subsidiary Sacramento Northern Railway run right debate until Jan 19 when the agency board is expected to make final routing decisions In another change under consideration the transit agency would drop a proposed station at 48th and streets and substitute one at 59th Street which is expected to draw more business because of nearby Sacramento Muncipal Utility District installations There would still be stations at 39th and streets and 65th and streets The transit agency board also has urged the county and other agencies to try to preserve land at three key locations in the Rancho Cordoba area which would be ideal for stations if the initial light-rail system Is eventually expanded east of Butterfield Way They are near where Folsom Boulevard meets Mather Field Road Zinfandel Drive and Sunrise Boulevard You'll never need bank resulted in his own death John Kelleher 65 and an unidentified robber were killed Sunday afternoon in the gunfire that erupted after three men walked into Korner on Rio Linda Boulevard and demanded money The customer was in the store at the time of the robbery but lived to tell about it killed the man who would have killed me if Kelly killed said the customer who asked that his name be withheld the shooting started if have killed Kelly and been unhurt himself I know that he have left me lying the survivor said during an interview Monday The man whose wallet was taken said he thought that only one of the robbers was armed But he conceded he get a good look at the action thing that entered the door was a he said I looked up at the face behind it and back at the gun The next thing I knew I was on the floor and some guy was going through my pockets was thinking going to get it in the back of the I even said a goodbye to my wife I think I heard three shots and then two shots but I say for sure As soon as the first bullet went off I figured going to die with my nose to this floor Kelly got him before he could get The man paused to wipe a tear from his eye was a pure gentleman Ihe at the combination market and gas station off and on Monday to pay their last respects at the padlocked store heard about it and just wanted to come said Willie Byrd "He gave me credit when nobody else would I would come in here and get 10 gallons of gas and not pay for it He was my brother Bob Kelleher of Yakima Wash said the store had been robbed seven times in the past year His brother had intended to sell the place next year and retire soon as I heard a Sacramento grocery store owner was killed I knew it was my Bob Kel-ieher said had a feeling about this for years It just had to Kelleher lived with his wife Jessie Mae in an apartment near the store Plant Operating Rancho Seco nuclear power plant which has been out of operation since last winter storm returned to service Sunday afternoon utility officials announced Monday Jeff Marx Sacramento Municipal Utility District spokesman said the plant will continue to operate at about 62 percent of capacity until the Pacific Gas and Electric Co replaces eight large transmission towers that collapsed during Wednesday's storm Without the towers the electrical grid in Northern and Central California cannot handle the full amount of power produced by Rancho Seco Marx said SMUD delayed the start-up of the plant while a defective motor on one of the reactor control rods was replaced but those repairs are now complete and the 913-megawatt nuclear plant is once again generating electricity Marx said Energy Standards Energy conservation standards designed to reduce utility bills for new houses in the city of Roseville have been approved by the state Energy Commission Similar conservation standards used in Placerville kept utility bills to $75 a month or $100 less than homes built under previous residential standards the commission re-' ported The standards used in Roseville require such measures as passive solar designs and moderate levels of insulation City officials estimated that 350 to 500 homes would be built during the next two years and use of the new standards will reduce peak electrical demand by up to 15 megawatts The conservation standards should help the city avoid the high ost of the commission said Innocent Verdict OROVILLE A Superior Court jury has found Melvin Melton 49 innocent of attempting to shoot down a crop-dusting plane as it flew over his Gridley home April 15 Melton was accused of firing two shotgun blasts at a plane piloted by David Foster of Biggs Foster was spraying an adjacent walnut orchard and testified that he saw a man on the roof of home and found superficial damage to the plane Two defense witnesses said they were with Melton at the time that he did not climb on his roof and that he had no weapons The jury deliberated about 314 hours after three days of testimony in the court of Superior Court Judge Loyd Mulkey Owner Sued WOODLAND The parents of a 7-month-old Woodland girl who was mauled to death by a Doberman pinscher last June have filed a lawsuit in Yolo County Superior Court against the owner James and Cheryl Stabler claim in the suit that a Doberman owned by Donald Morgan attacked their daughter Amanda June 13 inflict ing injuries that led to her death two days later Thomas Purtell the Stablers attorney said Monday that the Doberman was a guard dog at a Chevron service station that Morgan operates in Woodland He said that Morgan ordered James Stabler an employee to take the dog home for a weekend While in the living room the Doberman suddenly attacked the child and mauled her before her father could fight the dog
