oky 110 eye A wide variety of smoke violations were observed in September by inspectors of the City Smoke Abatement Division James Campbell smoke abatement engineer announced today Inspectors listed as observed offenders 25 apartment houses 229 Industrial plants fifteen laundries and cleaners 35 commercial plants fifteen schools and Governmental buildings 24 office buildings ten hotels 25 stores 45 open fires and 69 miscellaneous buildings In addition Mr Campbell reported the following violations were observed by railroad locomotives: Southern 29 Seaboard nine and Norfolk-Southern one Also inspectors actually timed sixteen violations by equipment of the Southern Railroad three of the Seaboard Railroad and two of the Norfolk-Southern Railroad Inspectors also timed six violations by industrial plants and one by a laundry Mr Campbell said that the Smoke Abatement Division gladly will give advice and assistance in any smoke problem Preparations are also being made for the local observance of National Smoke Abatement Week Oct 23-29 Mr Campbell is also expecting the proposed smoke abatement ordinance which has been in the hands of City Attorney John Shaw for some time to be Weathers is in City Jail Dixon's condition was reported as being "only fair" at Good Samaritan Hospital this morning and a nurse there said he did not seem to be improving An X-ray showed one bullet Business Section Two UC1E YANCEY ASKS ADHERENCE TO PRESENT LAW Inspection Division To Exercise More Delegated Authority By DICK YOUNG Charlotte News Staff Writer Many public hearings on zoning changes requests may be eliminated it was indicated today at City Hall Closer adherence to the law in handling appeals will result in this change City Manager Henry A Yancey said It will he added require greater responsibility for the inspection division in the enforcement of the zoning law Mr Yancey said that the chief function of the Board of Adjustment is to make technical investigations of zoning questions and to submit recommendations to the City Council Under the law the City Council is the final administrative body in zoning questions and this is the place where citizens and property owners have their Opportunity to be heard No change in the zoning law can be made except by the Council and the Board of Adjustment acts merely in an advisory capacity If protestants wish to present their cases the Council is the body to which they can appeal And if the protestants are not satisfied with the Councils decision they can appeal to the courts RELIEF FOR BOARD The policy of eliminating public hearings before the Board of Adjustment will greatly relieve this board whose members serve without pay of the extra heavy duties that have been assumed in the past the manager said Then too he said more definite handling of requests for building permits by the inspection division will provide further relief for the board members When an application is in clear violation th division can easily handle it without sending it on to the board he added Mr Yancey said that the new policy will not bar any citizen from presentation of his claims as any person can appeal before the Board of Adjustment if he desires as well as before the City Council Land Auction Is Set For Nov 21 Public sale of City-owned property off Statesville Road today was set for noon Nov 21 at the Courthouse City Manager Henry A Yancey said that the property which adjoins the 500-unit Negro housing project of Spangler will be sold in three tracts each of which has been appraised by the Charlotte Real Estate Board The bidding will start at the price set by the realtors The three tracts include: No business section 500 by 500 feet at Newland Road and Statesville Ave bidding to start at $10000 No 2-171 acres between Statesville Ave Newland Road and Irwin's Creek bidding to start at 815625: No strip fronting 1- 210 feet on Statesville Ave with depth of 150 feet bidding to start at $14400 One of the conditions of the sale is that the purchaser will be required to erect at least 178 Negro housing units on the property except that reserved for business Mr Spangler made overtures for purchase of the property in order to enlarge his current housing development which contains 500 units He told City officials that he would build 178 other houses if he could obtain title to the property Over $90 000 Added To Paid Taxes Of 1949 A total of $9099155 wiz added this week to the paid-up iso city taxes boosting the current collections to $251156030 The report from the office of George Livingston municipal accountant also showed payments this week of $91957 on 1948 taxes These payments sent the 1948 total to $295666259 actually represent 9906 per cent of the 1948 levy Payment this week on usual bumper crop of babies was no exception this year Figures today at the City Health Depts' Bureau of Vital Statitsics showed registration of 1544 births in the three months of July August and September which sent the total for the first nine months of 1949 to 4219 births The 549 births recorded in August were the third highest on record for a single month and September followed with just six less than the August total These two months are the only ones so far this year showing birth registrations in excess of 500 although March did produce a record of exactly 500 The record for the first three quarters of 1949 exceeds the registrations of 4159 for the same nine months last year but drops slightly under the total of 4390 for the January September total in 1947 In the first nine months of this year death claimed 1003 persons as compared to 1038 in the am months of 1948 and 1292 in 1947 Two Are Shot After Argument A Negro man who asked police to come and get him was being held at the police station this afternoon for the shotgun shooting of two other Negroes in Palmer Alley Jim Mc Lilly called police headquarters from the corner of Bland and Tryon Sts and said: "rm in trouble I shot a man" Two ambulances from Grier Thompson Funeral Home went to the scene of the shooting and found Poe Massey lying in the alley He was taken to Good Samaritan Hospital where the extent of his wounds were not immediately determined The other victim was not immediately identified McLilly told police that he shot Massey after an argument but did not explain what had happened Extradition Is Waived By Man A Rockingham main waived extradition in City Police Court today and will be returned to Georgia on a fugitive warrant William Jacobs appeared before Judge McA Currie and elected to return willingly to Georgia where he is wanted for alleged larceny of over $50 Judge Currie revoked a 1948 judgment of suspended sentence on Loflin 808 Wesley Ave and ordered him to serve these 42 years He was in the first motion picture "The Great Train Robbery" and has been in about 1650 since "I believe" he said here today "That I'm the champion movie maker of all time If anyone else has made as many pictures I don't know who it could be" The record books back him up The Hollywood production Encyclopedia an annual publication covering every phase of the motion picture industry credits him with 70 pictures in the past five years alone ALL-TIME SHERIFF He's the all time champion sheriff and has played the strong arm of the law 1000 times Matter of fact that's what he's doing here now He's in town with his manager Jack Sparks and his "Hollywood Deputies" a Western show that is open for bookings in Carolina towns late this month and next Sparks has himself made
