Bailey of Sacramento waS sentenced Wednesday to a 15- year to life term for the beating death of a 79-year-old Oak Park businessman last Nov 27 Superior Court Judge John Boskovich imposed the mandatory indeterminate sentence after Bailey a roofer pleaded guilty to one count of second-degree murder According to his probation report Bailey 35 had been hired by Leslie Earl Janak to put on a new roof on his awning business at 2980 35th St Janak gave Bailey $200 to purchase new materials but he bought only a few supplies and then did not work on the 'roof Bailey said Janak came to see him on Nov 27 and began insulting him While they argued in his garage Bailey said the elderly man grabbed him and refused to let go Bailey said he grabbed a tire iron and began beating hunk on the head the report said Bailey said he had no intention of killing Janak and "it just got out 'of control" The probation officer noted that Bailey "expressed considerable remorse over the killing" Janak's body covered with a bedspread was found in his station wagon parked by McCiatchy Park He had been reported missing by his nephew who told police Janak had been carrying some $200 in cash and wore Writer Investigators Wednesday continued to question and ponder criminal culpability In the case of a 93-year-old woman who was cut bruised and scraped late Sunday night while a patient at Countryside typically is given to those who have not eaten well Police reports disclose that Gallegos told the nurse on duty that when he tried to feed Mrs Lewis she pushed the can away As he tried to grab it his wristwatch struck her in the mouth The wound bled heavily and Gallegos tried to daub it clean but could not ho told police and nurse Mary Jenkins Ms Jenkins said she could not stop the bleeding either She said that when she entered the room she saw the cut on the mouth and that Mrs Lewis' skin was split on the neck and left arm "The skin was not gaping open but only split with some slight oozing of blood" Nurse Jenkins told police "Mrs Lewis' skin is very tender and splits very easily There have been several past instances when she was being handled that Mrs Lewis' skin split" she recalled for
