Judge Rejects Plea McGovern Fails In Try For All California Seats WASHINGTON AP A court challenge by California supporters of Sen George McGovern to regain all 271 of the state's delegates failed Monday when a federal judge refused to interfere with the Democratic Credentials Committee ruling that stripped McGovern of the delegates US District Court Judge George Hart Jr said the question of whether California's winner-take-all primary was fair and equitable was a matter for the Democratic National Convention to determine not the court The federal court should not become involved in disputes over the making or interpretation of party rules unless a clear constitutional question is at stake Hart said The California contingent entered court to seek the order against what a McGovern attorney termed "the rule of the jungle" in politics But Joseph A Califano Jr counsel for the Democratic National Commit tee said presidential politics not constitutional issues are what is involved and that "it would be a tragedy for the court to get into this arena" Hart said prior to his ruling on the matter that he expected an appeal regardless of his decision and announced the US Court of Appeals will hear arguments in the case California supporters of the South Dakota senator sought the order to prevent the Credentials Committee from throwing out the state's winner-take-all primary cities to prevent accidental war and for a joint political committee to open exchanges in many fields and to promote unification of North and South through peaceful means without outside interference
