and his mother were bound over to Criminal court Thursday on charges of assault with intent to commit first degree murder Frank Lutz and Mrs Antoinette Lutz 45 are accused of trying to kill Miami Policeman Anderson 30 on March 21 Neither the youth who has admitted firing three bullets into the policeman nor his mother testified at a preliminary hearing before Peace Justice Edwin Lee Mason The judge continued both under $25000 bond Anderson 30 of 3243 NW 87th st who was released frrnn the hospital several days ago did not appear at the hearing Lutz and his mother whispered back and forth throughout the two-hour hearing Mrs Lutz occasionally slapped her forehead apparently in disbelief at some of the testimony When Judge Mason announced that both the youth and his mother were being bound over young Lutz exclaimed: "First degree murder!"
