2 and any replies to these comments were due Nov 2 But on Sept 1 the already beleaguered granted extensions as fol lows: By VICTOR McELHENY Observer Staff Writer Federal proposals that would drop a third television channel Into Charlotte and take away the only standard television channel in Columbia are still waiting for comments from angrily buzzing broad casters The proposals come from the Federal Communications Commission boss of the na tion's airwaves The FCC said July 27 it wants to do two things: the use of ultra high frequency WU tele' vision channels 14 through 83 by creating "islands" communities where there would be UHF stations only Then on Tuesday the As sociation of Maximum Seri ice Telecasters which has been fighting both FCC proposals petitioned the FCC for a de lay until April 4 The association asked the FCC to spell out its engineer ing requirements to prevent the new "drop in" stations like the proposed Channel 6 for Charlotte from interfering with stations using the same chan nel within a critical distance That distance in the southeast is 190 miles In other words a television channel in this area can expect interference if another station broadcasts on the same channel from a point within 190 miles of its transmitter barna South Carolina Wis consin and Connecticut rural citizens would have to depend on outside television broadcasters for comment on their states' affairs The FCC got $2 million from Congress to underwrite an experimental UHF station in New York Any action on extending UHF service should await the outcome of the experiment (Some broadcast people note that New York City is a special case with the great interference offered by tne city's tall buildings The amount of interference offered to the higher UHF signals by hills of are in Wilmington Augusta a Knoxville Tenn and Bluefield Va All of these stations can be expected to object to a channel 6 in Charlotte unless a way of preventing interference can be found Two such methods are spoken of: making the broadcast antennas directional and lowering the broadcast tower to cut the range of the station To meet potential objections from the four channel 6 stations nearby any Charlotte channel 6 apparently would have to restrict itself to a local audience something it could do at less expense on a UHF channel or Install directional equipment on its broadcast antennas The broadcasters say that the FCC's requirements to avoid mutual interference are "ambiguous" Other "drop-in" third channels are proposed for these cities: Knoxville Tenn BirminghamAla Jacksonville Ha Baton Rouge La Oklahoma City Okla Dayton Ohio and Johnstown Pa Apparently the interference problem exists for each of these communities But the outcry about "drop-in" channels is as nothing In this broadcasters have been Joined by congressmen including Reps John Riley and Robert Hemphill (I)-SC) and Goy Ernest Hollings or South Carolina Petitions against the UHF plan by many public officials including Hollings were rejected by the FCC in late September The FCC said it would think about the petitions along with all the other arguments later Under the FCC plan which has the official name of Writer Robert Robinson a Charlotte attorney took charge of Charlotte Motor Speedway Friday after being nam ed trustee by Judge Craven Jr in Western District Federal Court here The speedway management filed an action entitled "Proceedings For the Reorganization of a Corporation" under Chapter 10 of the Federal bankruptcy laws The action came suddenly and set off a series of developments climaxed Friday afternoon by appointment of Robinson with wide powers of control over the speedway affairs Judge Craven signed an order prohibiting legal action against the speedway This will prevent the proposed public sale of the racing plant Monday at the Ca-harms Courthouse in Concord The speedway creditors had obtained the sale order from Caba rrus Superior Court The petition asking for reorganization of the speedway Car-porn tion set out that it is unable to meet its debts as they mature In granting the petition Judge Craven acted under a section of the bankruptcy laws permitting the reorganization of a company without formally throwing it into bankruptcy The speedway case will be handled under supervision of the judge and his trustee instead of being turned over to a Fednal Short Speech Gov Sanford tr a veled a long way to get in so few words during last Sunday's half-time ceremony of the Redskins Eagles game in Washington We were hoping he'd get to point out that the two quarterbacks running the whole show were Tar Heel trained Wake's Norman Snead a Duke's Sonny Jurgensen By DWAYNE WALLS Observer Staff Writer Attorneys for George King Cutter want the court to tone down the language in $600000 worth of damage suits against him by striking out some details of how he was involved in the death of Mrs Delette lienderson Nycurn They also question Mrs Nycum's life expectancy before her death on July 4 and the extent of financial loss her death means to two orphaned children These were the major points in two motions filed in Meek len Mrs Baldwin told police the child had drunk from a gallon can of kerosene on the floor in the kitchen at their home She said the can was supposed to be capped but that there was no cap on the can when she found the child with it She said it was the first time the child had bothered the can Summerville warned all persons to keep kerosene and any other poison or potential source of internal irritation away from children He said this type of clan ger should be brought to the attention of all parents No test was made to determine the amount of kerosene present in the child's system at the autopsy The coroner said he did not recall any previous deaths this year due to kerosene taken internally but said that several such deaths occurred last year He was found not guilty in a 10-day trial that ended Sept 22 The two civil suits were filed Oct 5 by the two attorneys hired as private prosecutors and by lkliss Emory an aunt of the dead woman The suit by the estate charges that Cutter was a proximate cause of the 38-year-old divorcee's death The one in behalf of her two children alleges mu tilatIon of Mrs Nyeum's body by Cutter and mental anguish by the children In their first answers to the suit Cutter's attorneys ask that the court strike out a total of 13 passages in the complaint against him some of them whole paragraphs Most of the passages in question deal with descriptions of Cutter's actions on the night of July 3 and 4 When according to his testimony he took Mrs Nycum's body from his converted bus at Morris Field across town to her home But Cutter's lawyers also want the court to strike the reference to his ownership of the bus and the statement that he is wealthy By JERRY MINN Obstrver staff Writer A form of pneumonia which resulted from swallowing kerosene caused the death of a 17-month-old child- here Friday morning according to Mecklenburg County Coroner Dr William Summerville Charles Ray Baldwin on of Mr and Mrs James Baldwin of 317 Myers St was admitted to Good Samaritan Hospital Tuesday night after his 'mother discovered I drinking kerosene He died there at 5:50 a Friday Intestinal inflammation due to the kerosene caused the child to vomit almost con tintsously After an autopsy Friday Summerville said that some of the vomit had been sucked into the child's lungs causing a form of pneumonia which was fatal.
