Teamsters Await US Court Rule By ROGER HONKANEN Niwi Stiff Writer Events took what appears to be a serious turn for the worse for the Teamsters International in Federal Court here yesterday evening Judge Braxton Craven heard arguments from 10:30 am until nearly 6:30 with only a brief pause for lunch and finally decided to continue the temporary injunction against trusteeship of Local 71 at least until today The judge said this morning he would compile a tentative finding of facts and make a tentative ruling sometime today on the injunction THE RULING would be subject to later revision after some 175 pages of testimony have been transcribed and he has had time to read them over carefully rather than rely on his memory as the necessary haste of today's action forced Should he rule today that the injunction should continue in effect the Teamsters International will have to abide by it until next April when the appellate court sits next or until such time as Judge Craven might make a final ruling in their favor should think there's enough of a prima facie case to warrant continuation of the present the judge said at the close of the hearing yesterday The hearing was hurriedly scheduled in telephone conferences between officials of the Federal Court here and the 4th Circuit Court of Appeals in Virginia where the Teamsters International sought to have the temporary injunction removed Wednesday The appellate court decided the injunction proceedings should be send back to Charlotte for immediate hearing rather than being heard in Statesville Tuesday as the injunction ruling originally stipulated The in Chilly Reminders Tryon St in case you need a reminder that it got down to 7 yesterday 11 this morning and will be down to 23 tonight (More weather on Page 1A 2A 13A The discussion about stalagmites and stalactites is purely academic them is plain old icicles They are hanging under the railroad overpass on means the speedway will pay oft most of the $900000 in debts that nearly forced its sale at auction late in 1961 Management will revert to a board of directors to be appointed by Judge Craven Under the plan some $400000 toward the debts will come from a new stock issue to existing! stockholders I I he plan calls for the slock1 sale five days after the "order i of confirmation'' issued today Trustee Robert Robinson said! jit will take several days to pre-j I pare the order meaning that! 1 the stock sale probably won't come until after next week I Other funds for speedway I debts and operating capital i will come from a $343000 mortgage loan and about $200000 earned In two races last year The new stock will be offered to stockholders at 75 cents a share Under the plan it can be exchanged for issued in a the speedway" move organized by a stockholders' committee last year That effort raised about $too 'See SrEEDWAY on rage 12R BILL OF PARTICULARS FILED State Lists Noe Charges rights at the city's Statesville Ave dump The bill of particulars was filed in Superior Court Thursday under an order issued by Judge Francis Clarkson The order requires Solicitor Ken Downs to turn much of its evidence against Noe over to Warren Stack Mr attorney The bill maintains that Noe "had implied ennsent and implied authority to receive lawful monies and other funds dp-rived from the sale and dispo sal of scrap materials for the purpose only of rereiving these lawful monies and funds in the name of and on account of the City of and that he was required to turn the money over to the city treasurer It charges that Noe received money weekly nr at slightly longer between April mill and June See NOE on Page The state in ils case against former city motor transport boss Ted Noe will maintain that Noe deposited $280 in in his personal bank account The "bill of to be used in Noe's trial next month cites six specific deposits of allegedly embezzled funds NOE IS CHARGED with embezzling funds paid In the city for scrap and salvaging We had a little story here a couple of weeks back about lawyers at the Courthouse referring to Ralph Kidd as Cannon ball Mr grandson Larry Grist rend the story hurriedly and rushed to the phone I'm not coming to see you any more The paper said you are a cannibal and they eat people lip GRADY SIGNS All kinds Pioneer NennMfrsEst 1904 Adv See TEAMS'!
