who lived after making an unsuccessful attempt to escape from Folsom Prison September 19th will be tried for the murder of Warden Clarence A Larkin and Guard Harry Martin The double charge of murder resulted from new indictments returned today by the Sacramento County Grand Jury accusing the five of slaying Larkin Last week the jury indicted them on charges of murdering Martin who died within a few minutes after he was stabbed through the heart Th convicts who may be the first to die in California's new lethal gas chamber to be constructed at San Quentin Prison are Ed Davis 35 the ringleader of the mutiny Wesley Eudy 33 Fred Barnes 39 Albert Kesseli 28 and Robert Lee Cannon 28 i Two Killed Two of their companions Clyde Stevens and Benny Kucharskl were killed during the furious fight whirh followed their attempt to kidnap Warden Larkin and hold him as a hostage in an escape plot District Attorney Otis Babcock who asked for the indictments called only two witnesses today They are Dr Proctor Day the prison physician and Richard Harrison Afee captainenrf the office clerk who ran out the back door and helped spread the alarm to guards when the seven convicts burst into the office while the warden was holding his customary Sunday morning interviews with prisoners In addition to -the four deaths atd the injuries incurred by the five surviving rioters the attempted break caused Guard Captain Wiliam Ryan and Guard James Kearns to suffer severe knife wounds Long Delay Seen Dr Day described the condition of the victims He said it will be six weeks before the five surviving convicts are able to come here for arraignment He believes each will recover however sufficiently to stand trial Davis and Cannon are in solitary confinement while the other three are in the prison hospital suffering from bullet wounds and club blows Dr Day also said he believes Guard Captain Ryan will recover although for days after the riot little hope was held for him "Ryan is not out of Dr
