attempting to invalidate the contract under which the city has been disposing of Hetch Hetchy power to the Pacific Gas and Elec-trio Company for retail distribution Legality Questioned Ickes attacked the contract on the ground it violates the provision of the Raker Act forbidding the city ever to sell power to a private company The contract has netted the City of San Francisco some 2000000 annually The city brief contends the contract does not amount to a sale of electric power to the and but simply is agency under which the company distributes the power in the retail markets as the agent of the city Objection Are Late It also states that before It was negotiated the contract was submitted to the interior department and that no objections were raised then nor sine until Secretary Ickes filed the present suit The brief further points out the value of the land granted to the city by the act does not exceed $245000 while the city gave the federal government land worth $165000 cash in the sum of $1250-WO a yearly rental of $33000 and roads valued at $592000 O'Toole adds: this case therefore as the government can obtain no benefit from compliance with section 6 of the Raker Act nor suffer no injury or loss by the violation thereof it cannot restrain the city from disposing of the power in any manner it finds possible to do par-' ticularly when the government wants an
