preliminary hearing and irujuest begins Tuesday afternoon Fuller was represented at today's proceedings by Albert Ecke The state will attempt to use an ante-mortem statement given by Burdick an hour before he died in Jackson Memorial hospital yesterday afternoon This statement was given to City Detective police say and names Fuller as the slayer but was not made before a notary Fuller also has been Identified by Miss Frances Madden who was with Burdick at the time of the shooting iSohliery Believed Motive Polite are holding to the theory that Fuller entered apartment earlv in the morning of November 19 with the intention of staging a robbery They believe that Fuller was seen entering tl ugh the back door by Burdick an Miss Madden and that he shot to escape Miss Madden told potice that she was In the kltihen of apartment at the time preparing some medicine for a headache when the door opened anil Fuller entered Burdick then entered the room and Fuller fired and fled According to
