The parties for "whom the writs were sworn out pro'est that their case is an ceedinglr good one. that they have possession of the stock, which is usually considered nine points in the legal entirety, and that they propose to stick: while on the other" hand the creditors failed to score at the tir-ish think they have excellent prospects for recover- inn'in nile of I set that thn other parties tallied first. At any rate, Messrs.

Stewart Whits will this 9:30 o'clock, rile application before Judge French of the Circuit Court, for an order citing tiie appearance before the Court ot Leonard, and the issuance of an order for the release of the stock, on the ground of wrongful possession. Messrs.S. will base their application upon Section 2.379 of tiie Code, tiieir claim being that the stock levied upon is the estate of Charles Stewart, deceased, and is consequently not to be attached, being in tbe u.inds of ihe probate Court. If successful in obtaining the release of the stock from Sheriff Leonard's a motion will be made for the removal of the present Executor and the appointment of a custodian of the ettate. On the other hand the gentlemen who seated themselves on the dry goods piles say that it Is nonsense to'claim that, because the stock happens to have been of Charles Stewart, W.

H. Stewart's indebtednesses are to go unpaid. Thus tbe fight stands, and it promises to be an active one. Meantime, the only American dry goods house in the City will propably be closed up'eventually, and another business establishment disappear from the list, which can ill afford the loss. The Stewart csse which has attracted so much attention among the legal profession, as well as outside the craft, since the attachment of the stock of goods of the Charles Stewart estate by Sheriff Leonard, on behalf of a number of creditors of the establishtneat, has reached its termination, for tbn present at least, in the decision given Judge French yesterday morning.

Theclaimsof the creditors mitside ot those who had the writ of attachment taken nut were sustained in their position, namely, that the sheriff has no power to attach in the hands of an eiecutor of an.estate, and left to him with the provision that lie carry on the business for a certain lengbth of time, according to the Co'deof Iowa. HIIA.MKD AI.3IO.STTO Mary Dirks, a German girl, who has. only been in this country about live- was placed in jail Saturday on warrant charging her with larceny. Tie facts arc rather peculiar. The giri has been living with Henry otoJtenbyrg, the well-known rich Germii farmer, about four miles out. of town.

There is also a hired man bv the name of Fritz working for Mr. Stoltenberg. Saturday morn'ng, just before starting for the" city, Fruz went out of the house for a few minutes, leaving his pocket-hook, a bank-book and a newspaper lying on the kitchen table. When he carne hack, as he claiioSy the pocket-book was gone, and he roughly accused the Dirks girl of taking it. She denied the theft with mnch show of feeling, and was hurt by tiie accusation, crying and showing every syinptom of truth.

came to tiai a wr.tnint sworn out for the girl, to the Stoltenberg farm with OHicer Martens just in lime to prevent a suicide! The girl, mortified to desperation, had gone to tbe bara, cud was in the very act of banging herself with a cloth wrapped about her neck. Sbe still protests her innocence, and Sheriff Leonard is inclined to believe her story. It seems too bad. asshe is apparently ft clever girl.
