Refuse. Refuse means the useless, unused, unwanted or discarded material resulting from normal community activities, or materials which by their presence may injuriously affect the health, safety and comfort of persons in the vicinity thereof. Refuse shall include, but not be limited to, garbage, putresci-ble organic material, rubbish, offal, swill, animal excreta, rubble, plaster or other waste resulting from the demolition, alteration or construction of buildings or structures Putrescible Organic Material. Putrescible organic material means any animal or vegetable matter, solid or liquid, which is capable of serving as a breeding media for flies or a food source for rodents or other animals or a source of obnoxious odors.

Garbage. Garbage means the putrescible animal, fish, fowl, fruit or vegetable waste or any thereof resulting from the preparation, processing, storage, handling or consumption of foods. Rubbish. Rubbish means all non-putrescible waste matter, whether combustible or non-combustible. Refuse Accumulation Nuisance.

Refuse accumulation nuisance means a condition caused by an accumulation of refuse in violation of the provisions of this chapter which is injurious to health, or is indecent or offensive to the senses so as to interfere with the comfortable enioyment of life or property, which affects at the same time an entire community or neighborhood or any considerable number of persons, although the extent of the annoyance or damage inflicted upon individuals may be unequal. 7.08.020 Accumulation of Refuse Prohibited. No person possessing any dwelling, or industrial, commercial or business premise or structure shall allow or permit any garbage, refuse or waste to collect and accumulate upon, or in, any such premise or structure except as otherwise provided by law. This provision shall not be construed as affecting any authorized waste disposal operation or properly conducted garden composting process carried on by a private individual in his own premises and for his own use. 7.08.030 General Waste Storage Requirements.

During intervals between collection or disposal, the storage, accumulation, collection, keeping, handling or maintaining of waste on premises where produced shal1 be performed in such a manner as to discourage the harboring and breeding of rodents and insects and ready access to the waste by dogs and other small animals, as not to obiectionably and unreasonably pollute the air, and as not to constitute a fire hazard. 7.08.040 Garbage and Rubbish Container Required. Every person possessing any dwelling unit, industrial, commercial or business structure or premise, other than an approved disposal site, where garbage or rubbish is produced or accumulated shall provide and maintain on the premises suitable containers of sufficient capacity to store Requirements. Garbage containers for other than bulk accumulation shall be a water-tight galvanized metal container, or its equivalent, with a tight fitting lid and shall not exceed 32 gallons capacity nor weigh more than 80 pounds when filled. The containers and covers shall be in good repair, leakproof, free from holes, fly-tight and rodent proof.

Containers shall be equipped with handles adequate to lift the weight of a full container without breaking or bending. Such container shall be maintained in a sanitary condition by the owners or users thereof and covers shall not be removed except for the purpose of placing waste therein or removing waste therefrom. 7.08.060 Bulk Waste. Any industrial, commercial or business establishment wherein waste is handled, produced or stored in large quantities may have such waste operation, subiect to review by the Health Officer, and the person in possession of such establishment shall comply with such requirements as the Health Officer may deem necessary for the sanitary storage, collection or disposal of such waste on the premises. 7.08.070 Rubbish Storage.

In any premise other than an approved disposal site where the votume of rubbish in excess of two (2) cubic yards is allowed to accumulate between intervals of collection or disposal, such waste shall be stored in fire-resistant containers approved by the local fire authority. 7.08.080 Dumping at Unauthorized Disposal Site Prohibited. Except as otherwise provided by law no person shall deposit or discharge or cause to be deposited or discharged any garbage, refuse or other waste in any place other than an approved disposal site or dump. 7.08.090 Burning of Waste. No person shall burn garbage or putrescible organic material unless such burning is conducted in a properly constructed incinerator approved by the Monterey-Santa Cruz County Unified Air Pollution Control District No person shall burn refuse except as permitted by the Monterey-Santa Cruz County Uni'fied Air Pollution Control District and the local fire authority 7.08.100 Removal and Disposal of Garbage.

Garbage containers on all premises shall be emptied and garbage shall be collected and properly disposed of not less than once a week. Such collection and disposal shall be by the authorized collector except that premises occupants may dispose of garbage in such manner and place as may be prescribed by the Health Officer. More frequent collection or disposal may be required by the Health Officer of premises where garbage is produced in such quantities, or is of such nature, that such increased frequency is necessary to prevent the occurrence of rodent and insect infestations or odor nuisances. 7.08.110 Removal and Disposal of Reufse. Refuse on all premises shall he collected or properly disposed of at such frequency as will prevent the occurence of a hazard or nuisance condition.

7.08.120 Investigation. The County Health Officer may, upon reasonable cause to believe a refuse accumulation nuisance exists, investigate the situation to determine whether such a nuisance does in fact exist. He shall have the power, when in the performance of his duty and upon his presenting his crednetials and identifying himself as an employee of the County Health Department to the person apparently in control of the premises, if available, to enter upon any such premises between the hours of 8 00 o'clock a.m. and 6:00 o'clock p.m but not in the dwelling ot any person without permission or a court order, to discover or to inspect anything or condition which appears to be a refuse accumulation nuisance. He may examine such premises, things or conditions, take such samples and make such tests as needed and take any other steps reasonably necessary for the proper investigation and determination of whether a refuse accumulation nuisance exists 7.08.130 Abatement of Refuse Accumulation Nuisance.

In the event the County Health Officer determines that a refuse accumula tion nuisance exists, he may aba'c any such nuisance in accordance with the provisions of Section 08 060 of the Santa Cruz County Code. A. 135(l-45th Ave was arrested for possession of marijuana and child neglect. Her four children, ranging in age from about two to eight years, were placed in protective custody. Capitola Police received a call reporting gunshots and screams in the area of the 1.100 block of 45th at about 4:38 a m. As the responding patrol car was entering the street, officers saw another vehicle leaving the area toward Capitola Road Thev went after the car and halted it a short distance away.

In the car were the Hell's Angels. Smith and Negherbon, Officers said Smith's face was bloody, but the blood come from another person. OH icers found two guns under the seat of the car and placed the two under arrest. Police said they were wearing the Death's Head insignia of the motorcycle gang. Meanwhile, sheriff's deputies responding to the assistance of the Capitola officers spotted the 17-year-old fleeing from the apartment.

They searched him and recovered a caliber snub-nosed revolver. He was placed under arrest for carrying a concealed weapon Further investigation led to the arrest of the mother of the tour children Police said a fight apparently had broken out in the apartment and a shot was fired, evidently without hitting anyone. Smith, thev found, apprently had gotten his face bloody during a tight 'with Charles Edward Gibson. 25.1-1245 East Clilf Drive. Gibson suffered multiple scalp lacerations, but relused treatment.

Five other persons in the apartment were questioned and released. Capitola Police said thev will ask the district attorney to file lelonv charges of discharging a luearm at a residence against Negherbon. Mrs. J. onnty cf Santtj rn; Dfc 3 1 I Public Notice ordinance no. 1794 ORDINANCE AMENDING THE SANTA CRUZ COUNTY CODE CHAPTER 108 NUISANCE ABATEMENT PROCEDURE The Board of Supervisors of thc-Counfy of Santa Cruz, Slate of California, do ordain as follows: Section I Chapter 1 08 is hereby amended by adding the following sections: 1.08.060 Nuisance Abatement Procedure. (a) Whenever a county officer with the responsibility to enforce any ot the provisions of this code determines that a public nuisance exists as the result of a violation of a county ordinance, he may issue a written order requiring that the conditions constituting the nuisance be abated within a period of ten days thereafter and shall forthwith serve the order upon the person maintaining such nuisance. An order of abatement shall continue in full force and effect until modified or rescinded by ho county officer issuing the same or until modified, vacated, or superseded by an order of the Board of Supervisors after hearing. The time specified in order of abatement may for good cause be extended by a written order of the issuing county officer.

The order of abatement shall advise the person served of his right to appeal to the Board of Supervisors and that the order of abatement will be stayed pending such appeal. (b) Any person ordered to abate a nuisance by a written order of a county officer issued pursuant to this section may, within ten days after receipt of said written order, file a written appeal to the Board of Supervisors with the Clerk of said Board specifying the grounds upon which it is made. Upon receipt of the appeal, the Board of Supervisors shall set the matter for hearing not less than ten nor more than sixty days following the date the appeal was filed. Such appeal shall stay the effect of the order of abatement until fhe Board of Supervisors hears the appeal and issues its order modifying, vacating, or affirming the order of abatement. Written notice of tne time and place of hearing shall be given to the appellant at least ten days 'prior to the date set for the hearing.

(c) In the event that the public nuisance is not abated in accordance with the county officer's order of abatement, the county officer may, upon securing the approval of the Board of Supervisors, proceed to the nuisance by force account, contract, or any other method deemed most expedient by the Board. (d) The county officer shall prepare and file with the Clerk of the Board of Supervisors a report specifying the work done, the itemized and total cost of the work, a description of the real property upon which the public nuisance is or was located, and the names and addresses of the record owner, the holder of any mortgaye or deed of trust of record, and any cither person known to have a legal interest in the property. (e) The Board of Supervisors shall hold a hearing on said report and any protest of obiec-tions thereto, and notice of the hearing shall be given to the persons with a legal interest in the property at least ten days prior to the date set for the hearing. The Board of Supervisors shall determine at the conclusion of the hearing the proper charge, if any, assessed for the work. If such costs are not paid by the owner of said property within thirty days of the determination by the Board of Supervisors, they shall be assessed upon the property involved as a special assessment.

Said assessment shall then be collected at the same time and in the same manner as county taxes are collected, and shall be subiect to the same penalties and the same procedure and sale in case of delinquency as is provided for ordinary county taxes. All laws applicable to the levy, collection and enforcement of county taxes shall be applicable to such special assessment. i i Each notice or order to be given or made under this section shall be served upon the person occupying the premises upon which the public nuisance exists, or if no person occupies the premises, the notice or order shall be posted upon sad premises in a conspicuous place, and in addition, a copy of the notice or order shall be served on the property owner of the permises. Service of each notice or order shall be made upon all persons entitled thereto either personally or by ma.hng a cony of the notice or order by certified mail, postage prepaid, return receipt requested, tn each such person at his adarrss as it appears on the last equalized assessment roll of the county or as known to Mo county officer If no address of any such person so appears or is rnoiMi to the county officer, then a cop of the notice or order shall be so mailed, addressed to such person, at the address of the premises. The failure of any such person to receive such notice or order shall not affect the validity of any proceeding taken under this section.

Service by certified mail in the manner herpm provided shall be effective on the date of the mailing.
