David Sylvan Fine, once a member of a campus radical group that spawned the revolutionary Weather Underground, waived a removal hearing here Thursday, one day after his arrest. U.S. Magistrate Richard Goldsmith set bail at $1 million and ordered Fine returned to Wisconsin to face federal charges of sabotage, destruction of property and interstate flight to avoid prosecution. Fine also is charged with murder in a Wisconsin warrant stemming from the bombing. Karleton L. Armstrong, 27, pleaded guilty on Sept. 28, 1973, to state charges of second-degree murder and arson and was sentenced to a maximum of 23 years in prison. His brother, Dwight Alan Armstrong, 24, and Leon Frederick Burt, 27, have eluded capture. Fine was arrested Wednesday in San Rafael, 18 miles north of here, after being identified through lengthy questioning and comparison of his teeth to dental charts.

He had been using the alias William James Lewes, the FBI said. The arrest was not announced until Thursday. Langford said Fine had been living in the San Rafael area since August and had registered at the College of Marin for some courses, which he later dropped. Fine, who told authorities he had been working as a warehouseman, rented a room at a house for $150 a month. "No bombs or munitions were found there, but I cannot discuss what was found there," Langford said.

But a jail official disputes that assessment. "Her physical condition has deteriorated again," Albert Johnson said Thursday in an interview. She has never eaten well and has no interest in what she eats." However, Johnson said Miss Hearst's mental acuity "has improved. She is cooperating to the best of her ability but this is limited and not to the degree I would like it to be," he said.
