city building commissioner Mitcham after having been granted Permit to erect a combination store and apartment house at Thirty-fourth street and Clasen boulevard was in7 terrupted in his building when the city commissioners annulled the permit last week The petition filed Friday sets forth that on Thursday Mitcham paid a building permit tee to the city treasurer and that Van Meter then refused to Issue the per mit Order Would Let DOWil Oars The petition asks the court to issue an alternative of mandamus ordering Van Meter to issue the permit or to ahoy cause why it should not be issued The court is asked to Issue a peremptory writ of mandamus when a hearing is held Issuance of the peremptory order would have the effect of letting down the bars for the building of a grocery store anywhere in a residence section Annulment of the permit followed a protest by residents of the section in which the building was to be erected Constitutional Provisions Cited Mitcham' petition alleges that the ordinance involved No 1913 passed June 12 1917 violates both the constitution of the United States and the state constitution botb of which forbid the taking of property without due process of law the petition de-dares The fourceenth amendment to the United States constitution which forbids a state to deprive any person of property without due process of law or to deny equal protection McDougal chief of consul for Wright issued the following statement: The people' have a right to know through the newspapers the real facts and issues brought out at the trial ef Judge Wright The main points of interest are: 1 The exoneration of Judge Wright 2 The methods resorted to to pro cure evidence 3 The fact that the prosecution was Instigated by disappointed litigants 1 Judge Wright was exonerated because to use the language of the justice in deciding the case "there has not been an ounce of evidence produced to show any bribery" The prosecution offered no evidence of any bribe ever having beenoffered or received by anybody except the admission by Charles Page and his associate Mc Cray that Page had offered to expend $505005 in Judge Wright's interest in an unsuccessful effort to
