Phil Burleson said judgment in a sanity hearing might be affected by an appeals decision. In a letter to Judge Holland, Burleson indicated he would ask for a continuance. The complication apparently arose in the question of Ruby's staius if the Stale Court of Criminal Appeals overturned hi.s death sentence conviction. If he is found insane before appeal action he will be sent to a state institution. Burleson is expected to file a motion for continuance II agreement is not reached by state and defense attorneys.
