investments it is Important I for administrators and distributees that the assets on their respective books he et lip thereon at the legally correct figuics to the end that a reliable forecast may be made as to profit or loss on a proposed sale and that the gain or loss on completed transactions may he accurately computed Unfortunately the statutes court decisions and departmental rulings as to the post mortem status of a cedent's estate in relation lo the income tax on profits on sales of capitil assets are ambiguous and conflicting It will be the pm pose of this article to piesent a brief survey of the situation In the interest of brevity amounts of money mentioned in the decisions me usually given in round numbers Sales by Administrators For manv yea is the Treasury regulations declared that where an administrator sells property of the estate for more than its value at the death of the decedent the excess is income to the estate Such regulation was held imahd in McKinney (1926) 62 Court of Claims 180 In that case decedent had purchased 4800 shares of slock of the General Asphalt Co for $177000 prior to March 1 1913 upon whieh date said shares had a matket Value of $187000 The value was $67000 on the date of death April 28 1918 between which date and December 31 1918 the executors sold said shares for $160000 The commissioner ruled that the estate had gained $93000 hut the cotiri decided otherwise saying: Of course theie was no cost to the executors Thev were the personal representatives of the decedent The stock was the same stock as it had been in the hands of the decedent and as stated had lie lived and sold the sum himself there woul have been no question of taxable gam The fact that they W'ere executors did nut alter the situation Petition for States Supreme Court from the decision of a special United States District Court which restrained the commission from preventing Southern railroads from putting into effect a voluntary reduction of twenty cents a ton in freight rates on coal ship-i nients to lake ports The appeal was taken from the decision handed down in Richmond Va April 14 The case which resulted in an injunction being issued against the eommiss'on Was instituted by more than 500 Southern cral operators Judge Lindsey Faces Disbarment Charge Acceptance of Fee Laid to Former Colorado Jurist DENVER June 10 Disbarment pioceedings against Ben jJndsay former judge of the Denver Juvenile Court and nationally known authority on Juvenile delinquency have been begun here by Attorney Genet al Boatright It was learned that the disciplinary measures against the former judge were at the request of the Ooloiado Bar Association The complaint charging professional misconduct as a member of the bar" sets forth that Lindsey administratrix for $97600 The administratrix claimed a loss of either $10000 or $400 the board decided that $400 was the amount of the loss saying: We are clearlv of the opinion that the taxpaver is not entitled to deduction of the larger amount since the cost to the decedent was the basis from which he would compute a gam or loss on the sale but is not the basis for his estate which is the value
