ABC in US District Court Thursday and demanded that the television network continue its payments to the league The same court is already considering a $132 billion antitrust suit filed last October by the USFL against the National Football League Commissioner Harry Usher said he has been informed by ABC that the network does not intend to make scheduled rights payments of $28 million due on June 1 and July 1 and $14 million due prior to June 29 The first two payments are part of the $14 million contract ABC and the USFL made for the 1985 season The last payment is for playoff and championship game telecasts Usher said ABC informed the league it would withhold the payments based on the USFL leaving certain cities designated in its original contract including Chicago Detroit Philadelphia and Boston There is no justification for withholding $7 million" Usher said We are suing to get that $7 million ana if we are damaged by their action for more We are also suing them for disparaging the product in the way their annquncers sales force and management have treated and spoken about it in public and on the air If there is a valid dispute (over the $7 million) let us resolve it or let a court resolve it But you cant not make the payments They are abrogating a contract unilaterally Usher said We are delivering the product We are paving players and coaches and travel expenses We are putting on the show They are collecting from advertisers ABC is taking an unrealistic unreasonable unjustifiable position in terms of not paying the last $7 million for a product we are delivering Thats half a seasons rights fees and it amounts to economic coercion "This money is extremely important as anybody who has followed our finances this year knows and as ABC knows I think we can survive without the ABC payments but it would be extremely painful the commissioner said ABC had no immediate comment on the USFL action ABCs original contract with the USFL paid the league $9 million for the regular season and $14 million for playoffs and championship games for each of the leagues first two years The contract also contained an option for two additional seasons and ABC exercised that option for $14 million for the 1985 regular season and the same $14 million for playoffs and championship game According to Usher that was a minumum fee with the parties agreeing to negotiate higher rates based on the networks success with its first two years of telecasts There have been no negotiations for higher rates Usher said On Feb 1 when I took office I almost immediately got a letter from ABC saying it intended to withold payments on June 1 unless we negotiate a resolution of reduction in fees for moving out of certain cities" "These negotiations have produced no agreement and weve been advised ABC will not make its payment on June 1 or for the rest of the season which amounts to $7 million We have no alternative but to sue and try to get a court to order them to pay because they are getting and will still get the product The USFLs Chicago franchise is not active this season The Michigan Panthers the league's first champions merged with Oakland and left the Detroit area
