rumj IHlWLLHim ACTION OF COUNTY SAID ILLEGAL Transfer of Health Money to General FuntJ May Mean Fight The action ot the board of Supervisors was absolutely illegal declares Daniel Marceau attorney for the San Joaquin local health district regarding the transferring by the supervisors of $27000 from the health district fund to the general fund of the county The supervisors have a right to return the money to tho general fund of the county4 asserts District Attorney Edward Van Vranken He declares that the action Is Similar to that taken with certain reclamation districts where money Is loaned to expedite the work and then taken back immediately upon the availability of tax money The money was given the health district by the county when it was first organized Nbw the board of supervisors has no control over the funds of the health district since it has been declared by the superior and supreme courts" to be a state agency separate and distinct from the county according to Attorney Iarceau The attorney for the health district issued the following statement concerning the matter: In my opinion the action of the bc'rd of supervisors lu transfer ring the sum of $27000 from the San Joaquin local health district fund to the general fund was illegal and void This money was raised by the levy of a special tax by the board of supervisors The local health district act provides that all moneys so collected shall ho paid into the couuty treasury to the credit of the particular local health district fund and shall te paid out on the order of the district board signed by the president and secretary thereof" The decision of the supreme Court and also the decision of the superior Court was to the effect that the local health district is a state agency separate and ute tinct from the county This being S0f it naturally follows that the board of supervisors have no cou-trol over the funds of the district Health District Trustees to Discuss Matter Tonlfflit The board of trustees of supervisors reads as follows: To the Honorable Board of Su pervleois: I wish to report that I have examined the proposed route for a public highway on Bouldin island and the locations best suited for the installation of ferry to connect the island with the mainland near Terminous and with Andrus island in tiucra xnento county The total length of the road will be approximately five and one-half milea four and one-half miles of i which will he on the levee and one across the lower tod of the telgnd The levee fe well above tne high-water grade and of excellent material to make an earth road or a foundation for an improved foad when It is desired to construct one The Jiaight and width of the levee are sufficient to afford a mad twentv-four feet in width There is about one mUe of the proposed road across the lower end of the island that is over peat soil and along a drainage ditch It will he necessary to construct a grade here with a ditching machine such as is used upon the inland his will piob-ably coat $40ftO The grading of the lev portion should not cost to exceed $4000 The installation of ferry slips near Terminous and the one at the ferrv between the counties will cost $30UO
