California Supreme Court reviewing the drug possession case of comedian I lip Wilson was urged Thursday to strike down a key provision of Proposition 8 the so-called "victims hill of rights The court section of Prop 8 SAN FRANCISCO (UPI) Officials of Alameda County have asked a state appeals court to overturn a lower court ruling banning prayers in time for two high school graduations tonight Deputy County Attorney William Rundstrom asked the state Court of Appeal late Thursday to reverse an order striking the prayers from the ceremonies issued by Superior Court Judge Raymond Marsh at the request of three high school seniors The three-judge panel of the appeals court deliberated on the controversy for 15 minutes Thursday evening before announcing they would not make a decision until today at the earliest Marsh ordered the prayers out of graduation ceremonies at Livermore and Granada High Schools after he agreed with the assertion of American Civil Liberties Union attorneys that the prayers would violate the constitutional separation of church and state The judge said both the state and federal constitutions require officials to be neutral in matters of religion He said having prayers at graduation violated the school officials duty of neutrality In his petition to the appeals court Rundstrom said the prayers did not violate the law because graduation ceremonies were voluntary and it was the custom practice and policy of the school board to include them at graduations A brief invocation at a graduation ceremony at which attendance is voluntary does not transgress the First Amendment Rundstom asserted The case was filed by the ACLU on behalf of three seniors at the high schools after the Granada student graduation committee voted 35-11 to retain the short escaped mental patient wanted for kidnapping and rape in Pennsylvania who broke out of the Chino state prison last week was charged Thursday with the hacking and stabbing massacre of four people Corrections officials said Cooper was in the pnson under an alias but admitted they might have "contributed to a bad mistake by placing him in a minimum security facility three days before the Sunday
