A spokesman for the National Welfare Rights Organization said a federal court suit was planned as a result of complaints by the poor that commencement fees were beyond their means. Cornelia Williams, one of the parents who complained, said her son Jessie received a bill for more than $33 as the price for full participation in graduation exercises at DuSable High School on the South Side.

Rush Named Envoy To West Germany WASHINGTON (AP) President Nixon formally announced he will nominate Kenneth Rush, president Union Carbide to be ambassador to West Germany.

Rush, 59 will succeed Henry Cabot Lodge, now chief U.S. negotiator at the Vietnam peace talks in Paris. To be ambassador to Iceland, Nixon is nominating Luther I. Replogle of Oak Park, 111., founder and president of Replogle Globes Inc. Replogle, 67, will succeed Karl F.

Rolvaag, former Democratic governor of Minnesota, who has resigned. Nixon also said he will nominate Henry A. Schwarz of 111., to be U.S. attorney for the eastern district of Illinois for a four-year term. Evans Officer Declines To Testify SUBIC BAY, PhiUppines (AP) Lt.

(j.g.) Ronald C. Ramsey, deck officer of the U.S. destroyer Frank E. Evans on the night she was sliced in half by Uie Australian aircraft carrier Melbourne, declined to testify yesterday before the investigating board and asked to be permanently excused from ttie hearings. Ramsey, 24, who has been advised he is of in the collision, claimed his constitutional rights had been violated.

His attorney, Navy L. Frederick Tilton, 27, said Ramsey decided not to testify because he had been denied access to testimony from previous witnesses, refused the right to cross-examine witnesses and refused the right to recall witnesses. CAR QUARTERED BY TRAIN SHABBONA, 111. (AP) A car was quartered Monday night by a train, the impact of the collision throwing sections of the car as far as 220 feet, but the two occupants escaped with minor injuries. Police said Gladys VancU, 32, Barbara Cripps, 27, both of Sandwich, pulled slowly onto the country crossing and were hit by a high-speed Burlington railway passenger train. The front end of toe car was tossed 50 feet by toe impact, toe roof 150 feet, the rear quarter 205 feet and the rear end of the auto 220 feet, police said.
