The decision means that the smelter may not operate from the middle of March for eight months during eaoh year, when the prevailing wind Is such as to blow the sulphur fumes towards Benicia, Solano county. The principal ground of the appellants was that Solano county's district attorney could not bring the suit because the smelting plant was located In Centra Costa county.
